Short-term let Standard Licence Conditions

The following are the Council’s Standard Licence Conditions for short-term let licences in North Ayrshire. These conditions are separate from, and in addition to, the mandatory licence conditions set out in Schedule 3 to the Civic Government (Scotland) Act 1982 (Licensing of Short-Term Lets) Order 2022, as amended. North Ayrshire Council applies these standard conditions to support consistent regulation, public safety, residential amenity and regulatory compliance. Additional or bespoke conditions may also be attached to an individual licence where this is considered necessary and proportionate in the circumstances of the particular case.

1. Licence Changes and Serious Incident Notification

1.1 The licence holder must notify North Ayrshire Council as soon as reasonably practicable of any change of circumstances relevant to the short-term let licence or the operation or management of the premises.

1.2 Without prejudice to the generality of paragraph 1.1, this includes any change to:

    1.3 The licence holder must also notify North Ayrshire Council as soon as reasonably practicable of any serious incident at the premises which may affect guest safety, neighbour amenity, or continued compliance with the licence, including structural damage, structural collapse, gas leak, fire, explosion, or any incident requiring attendance by the emergency services.

    1.4 Compliance with this condition does not remove the requirement to make any amendment, variation, transfer, renewal, confirmation or other application required by the statutory framework or the Council’s policy.

    2. Anti-Social Behaviour and Nuisance

    2.1 The licence holder must take reasonable steps to manage the premises in such a way as to prevent and deal effectively with any anti-social behaviour, nuisance or disturbance arising within or from the premises and affecting any person in the locality of the premises.

    2.2 The licence holder must, in particular, take reasonable steps to:

      2.3 The licence holder must notify North Ayrshire Council as soon as reasonably practicable of any significant incident of anti-social behaviour affecting or emanating from the premises which has required police involvement.

      3. Privacy and Security

      3.1 The licence holder must manage the premises in such a way as to respect and protect the privacy and security of neighbouring residents.

      3.2 The licence holder must ensure that guests are made aware of any rules applying to shared entrances, common areas and access arrangements.

      3.3 The licence holder must ensure that any shared doors, gates or security entrances are properly and securely closed after use.

      3.4 The licence holder must ensure that any keys, access fobs, codes or other means of entry provided to guests cannot be used to gain access to the premises or any shared area after the end of the let.

      4. Noise Management and Late Arrivals

      4.1 The licence holder must take reasonable steps to ensure that no noise arising within or from the premises gives rise to nuisance or unreasonable disturbance to neighbouring properties or other persons in the locality.

      4.2 The licence holder must ensure that guests are made aware, before and during their stay, of the need to minimise noise and to behave respectfully, particularly during evening and night-time hours.

      4.3 The licence holder must ensure that no guest first arrives at, or checks in to, the premises after 10pm.

      4.4 The licence holder must ensure that no amplified music is played within the premises, or in any garden, balcony, patio or other external area forming part of the premises, after 10pm.

      4.5 Where the premises are flatted or otherwise adjoin other residential accommodation, the licence holder must comply with any requirement imposed by the Council for suitable floor coverings or other reasonable noise mitigation measures.

      5. Key Boxes and Entry Devices

      5.1 The licence holder must not affix a key box, lock box or any other device used to facilitate guest entry to any public infrastructure or to any jointly owned or common private infrastructure without the prior written permission of the relevant authority or owner.

      5.2 The licence holder must produce evidence of such written permission to North Ayrshire Council on request.

      6. Waste, Recycling and Bin Management

      6.1 The licence holder must provide adequate information to guests on, and adequate facilities for, the storage, recycling and disposal of waste arising from the use of the premises as a short-term let.

          7. Hot Tubs and Spa Pools

          7.1 Where a hot tub, spa pool, whirlpool bath or similar facility is provided for guest use, the licence holder must ensure that it is suitably located, properly maintained, operated in a safe condition, and managed in a manner which prevents nuisance or disturbance to neighbouring residents.

          7.2 The licence holder must ensure that suitable and sufficient cleaning, inspection, testing and disinfection procedures are in place for any such facility.

          7.3 The licence holder must provide guests with clear written instructions and house rules on the safe use of the facility and on any restrictions applying to its use.

          7.4 The licence holder must ensure that any hot tub, spa pool, whirlpool bath or similar facility is kept securely covered when not in use.

          7.5 The licence holder must ensure that guests do not use any hot tub, spa pool, whirlpool bath or similar facility after 10pm.

          8. Hot Tub Legionella and Monitoring Requirements

          8.1 Where a hot tub, spa pool, whirlpool bath or similar water facility is provided for guest use, the licence holder must ensure that a separate and suitable risk assessment is carried out for that facility, including assessment of the risk of legionella and other waterborne bacteria.

          8.2 In managing that facility, the licence holder must have regard to relevant Health and Safety Executive guidance relating to spa pool systems.

          8.3 The licence holder must ensure that any control measures, testing, monitoring, cleaning and maintenance identified by the risk assessment are implemented and recorded.

          8.4 The licence holder must provide a copy of the risk assessment, together with any associated testing, cleaning, inspection and maintenance records, to North Ayrshire Council on request.

          8.5 The licence holder must ensure that guests are provided with information on the safe use of the facility and on any health risks associated with it.

          9. Solid Fuel Appliances and Wood-Burning Stoves

          9.1 Where there is a solid fuel appliance, open fire, wood-burning stove or similar appliance within the premises, the licence holder must ensure that the appliance, and any chimney or flue serving it, are maintained in a safe condition.

          9.2 The licence holder must ensure that any chimney or flue associated with such an appliance is inspected and cleaned at least once every 12 months by a suitably competent person.

          9.3 The licence holder must keep a record of each inspection and cleaning and must produce that record to North Ayrshire Council on request.

          9.4 The licence holder must provide guests with clear instructions on the safe use of any such appliance.

          9.5 The licence holder must ensure that the presence and use of any such appliance is appropriately reflected in the fire safety arrangements for the premises.
