Public Processions Standard Conditions

Standard Conditions

Civic Government (Scotland) 1982, Part V (Public Processions)

  1. The Organiser must bring these Conditions to the notice of everyone participating in the Procession.
  2. No band shall play and no loudspeaker shall be used before 8am or after 9pm. This includes using a drum or other sound-generating instrument to mark time.
  3. No musical instruments or loudspeakers can be used within 100 metres of any place of worship (this condition applies whether or not a religious service or ceremony is in progress).
  4. The Organiser and the Chief Steward shall identify themselves to the Police Officer in charge at the commencement of the Procession.
  5. All stewards shall be easily identifiable to marchers and the Police.
  6. The Police Officer in charge may alter any arrangements for the Procession (including dividing the Procession into smaller groups or re-routing it in whole or in part), if he or she considers that that is necessary having regard to the need to minimise risks to: (i) public safety; (ii) public order; (iii) damage to property; or (iv) disruption of the life of the community;
  7. The Organiser, Chief Steward, and stewards shall follow any instructions given by any Police officer. Apart from those instructions, the route, timing and all the other details given in the Notification shall be treated as Conditions to be followed.
  8. Those marching, including stewards, shall not do so more than four abreast and shall keep to the near-side or left-hand side of the street, except in one-way streets where they must keep to the right-hand side.
  9. All statutes and common law provisions concerning public order shall be observed by all persons in the Procession, and any person accompanying the Procession; including local Byelaws prohibiting drinking of alcohol in public.
  10. The Organiser shall co-operate with the council and Police Scotland in reviewing the conduct of the Procession afterwards.
