North Ayrshire Council (NAC) has an obligation to their tenants and residents, through the single outcome agreement, to make North Ayrshire a working, safer and healthier environment to work, live and visit.

In response to increasing complaints NAC introduced the Environmental Enforcement team in April 2016 to help address issues of environmental crime.

Enforcement officers have the authority to question those suspected of committing an offence and collect data which may be used to corroborate events.

The type of information gathered includes:

  • CCTV images
  • audio recordings
  • first name
  • last name
  • address
  • date of birth
  • age
  • place of birth

(failure to provide details to an authorised officer is an offence)

What we do with your data:

  1. CCTV images are stored in a secure location and are automatically deleted after a period of 31 days.
  2. Data Collected may be used to issue a fixed penalty notice.
  3. Payment of a fixed penalty notice will remove the possibility of prosecution and will result in the data being deleted from our records.
  4. Fixed penalty notices that are not addressed within the required timescale may be passed to the Procurator Fiscal for consideration of prosecution.
  5. In the case of item 4 above, CCTV and audio data will be retained for an extended period to allow for legal requirements to be met.

Who has access to your data:

  • your personal data is protected by the Data protection Act
  • your data may be shared with Police Scotland or the Crown Prosecution Office if required for prosecution purposes
  • your information may be requested by other local authority departments in relation to corporate fraud
