Mobile Smart Cameras – Fair Processing Notice

In order to achieve its mission ‘To improve the lives of North Ayrshire people and develop stronger communities’, North Ayrshire Council (NAC) has laid out five strategic priorities. One of our priorities is ‘Protecting and enhancing the environment for future generations‘.

The Environmental Enforcement team were introduced in April 2016 to help address this priority and tackle the issue of environmental crime such as fly tipping, litter louting and dog fouling.

Mobile smart cameras will be strategically and overtly placed to help capture individuals who commit environmental crime. We will ensure that in the locations where the cameras are deployed appropriate signage will be displayed.

Purposes of processing your personal data

The footage we record is used for the prevention and detection of crime and to protect public safety. Where mobile cameras are deployed, signage will be displayed prominently at each location.

Cameras will capture:

  • video images
  • car registrations

Where it is suspected that a crime has been committed we will use this data to obtain further details including name, address, date of birth from other organisations such as DVLA or Police Scotland and thereafter issued a fixed penalty notice.

Our justification for processing the data under the Data Protection Act 2018 is to comply with our legal obligations under the Environmental Protection Act 1990 section 87 & 33 and the Dog Fouling (Scotland) Act 2003, and to ensure that we comply with our statutory tasks as a public authority.

Who we will share your data with

Your data may be shared with Police Scotland or other crime prevention agencies if required for prosecution purposes. We may also share your information with other public bodies, such as HMRC and will do where the law requires this.

Retaining your data

Images will be retained for a period of 1 year and then deleted. There may be exceptions where the images will be retained for an extended period to allow for legal requirements to be met.
