1. Arran Local Plan Area

1.1 N/04/01044/PP and N/04/01045/LBC: Lamlash: St. George's Church

Mr J McCourtney, c/o CRGP Architects & Surveyors, 26 Herbert Street, Glasgow has applied for planning permission and listed building consent for the change of use and conversion of a church to form 8 flats and the erection of an extension to the rear of the church to form 6 flats with associated parking at St. George's Church, Lamlash, Isle of Arran. Objections have been received from the owners/occupiers of 'Miramar', Sarah Thomson of 'The Old Manse', and Mr and Mrs V B Shaw, 'Monawilline', all Lamlash. One letter of representation has also been received from Lamlash Improvements Association, c/o Carol Mitchell, 'Tigh Na Cuile', Lamlash.

The Sub Committee, having considered the terms of the objections and representation, agreed to grant (a) the planning application, subject to the following conditions:-

1. That, prior to the commencement of the development, the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority full details and/or samples of the proposed external finishing materials to be used throughout the development, including details of proposed paving materials to the front of the church.


2. That no development shall take place until there has been submitted to, and approved by, North Ayrshire Council as Planning Authority a scheme of landscaping, which shall include details of species, planting densities, soil treatment and aftercare and shall include indications of all existing trees and hedgerows on the land and details of any to be retained, together with measures for their protection in the course of the development.

3. That no development shall take place until details of any additional boundary treatment to be used in the development are submitted to, and approved by, North Ayrshire Council as Planning Authority. For the avoidance of doubt, the boundary wall at the site entrance shall be retained and the opening widened only as required to allow the safe access/egress of traffic and pedestrians.

4. That all planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting season and seeding seasons following the occupation of the buildings or the completion of the development, whichever is the sooner, and any trees or plants which, within a period of five years from the completion of the development die, are removed or become seriously damaged or diseased, shall be replaced in the next planting season with others of a similar size and species, unless North Ayrshire Council as Planning Authority gives written consent to any variation.

5. That the developer shall secure the implementation of an archaeological watching brief, to be carried out by an archaeological organisation acceptable to North Ayrshire Council as Planning Authority, during development work. The retained archaeological organisation shall be afforded access at all reasonable times and allowed to record and recover items of interest and finds. Terms of Reference for the watching brief will be supplied by West of Scotland Archaeology Service. The name of the archaeological organisation retained by the developer shall be given to North Ayrshire Council as Planning Authority and to the West of Scotland Archaeology Service in writing not less than 14 days before the development commences.

6. That the proposed development shall be provided with an adequate and wholesome water supply, details of which shall be submitted for the written approval of North Ayrshire Council as Planning Authority prior to the commencement of the development.

7. That the surface water drainage shall be excluded from the septic tank.

8. That, prior to the commencement of the development hereby approved, details of a scheme to treat the surface water arising from the site in accordance with the principles and practices contained in CIRIA's "Sustainable Urban Drainage Systems Design Manual for Scotland and Northern Ireland 2000", shall be submitted to, and approved by, North Ayrshire Council as Planning Authority. Thereafter, any scheme that may be approved shall be fully implemented prior to the completion of the development and maintained thereafter to the satisfaction of North Ayrshire Council as Planning Authority.

9. That visibility splays of 2.5 m x 60 m in both directions, shall be provided and thereafter maintained on land within the applicant's control, such that there is no obstruction to visibility above a height of 1.05 metre measured above the adjacent carriageway level to the satisfaction of North Ayrshire Council as Planning Authority.

10. That the first 2 metres of the access measured from the edge of the road carriageway shall be surfaced in bituminous material in order to prevent deleterious material being carried on to the carriageway. The access to the site shall be designed in such a way to ensure that no surface water discharges onto the public road.

11. That details of footway provision between the site frontage and the existing footway on Shore Road shall be provided for the further written approval of North Ayrshire Council as Planning Authority prior to the commencement of the development. Thereafter, any details as may be approved shall be implemented to the satisfaction of North Ayrshire Council as Planning Authority prior to the occupation of the development.

12. That the finished floor levels of the ground floor of the development shall be no less than 5 metres AOD.

13. That no part of the extension hereby approved shall be occupied until the conversion/rehabilitation of the listed building is substantially complete.

14. That, prior to the occupation of any part of the development hereby approved, the parking area shall be completed in accordance with the approved plans to the satisfaction of North Ayrshire Council as Planning Authority; and

(b) the listed building consent subject to the following conditions:-

1. That, prior to the commencement of the development, the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority full details and/or samples of the proposed external finishing materials to be used throughout the development, including details of proposed paving materials to the front of the church.

2. That the finished floor levels of the ground floor of the development shall be no less than 5 metres AOD.

1.2 N/04/00937/PP: Blackwaterfoot: Site to the South and West of Tighenmenach

Mr and Mrs McChlery, c/o The Architectural Collaborative, 51/9 Cockburn Street, Edinburgh have applied for planning permission for the erection of a detached dwellinghouse for an agricultural worker on a site to the south and west of Tighenmenach, Blackwaterfoot, Isle of Arran.


The Sub Committee agreed, subject to the applicant entering into a Section 75 legal agreement to restrict the occupancy of the house to a person employed locally in agriculture or their dependants, to grant the application subject to the following conditions:-

1. That, prior to the occupation of the dwellinghouse hereby approved, visibility splays of 2.5m x 60m shall be provided and maintained on land within the applicants' control, such that there is no obstruction to visibility above a height of 1.05 metre measured above the adjacent carriageway level, to the satisfaction of North Ayrshire Council as Planning Authority.

2. That, prior to work commencing on site, details including dimensions and location of intervisible passing places on the main access road shall be submitted to, and approved in writing by, North Ayrshire Council as Planning Authority.

3. That, prior to the occupation of the dwellinghouse hereby approved, passing places shall be formed in accordance with the requirements of Condition 2, and maintained to the satisfaction of North Ayrshire Council as Planning Authority.

4. That, before the commencement of the development hereby approved, details of the drainage/sewerage disposal scheme shall be submitted to, and approved in writing by, North Ayrshire Council as Planning Authority.

5. That the development hereby approved shall not be occupied until the approved drainage/sewage disposal scheme is operational in accordance with the details approved in terms of Condition 4.

2. Ardrossan/Saltcoats/Stevenston Local Plan Area

2.1 N/04/00961/PP: Ardrossan: 23 Parkhouse Road

Cunninghame Housing Association, 82-84 Glasgow Street, Ardrossan, have applied for planning permission for the erection of a two storey residential development comprising 12 flats and three houses with associated car parking at 23 Parkhouse Road, Ardrossan. An objection has been received from Jas Campbell & Co Solicitors on behalf of Mrs J McBlain of 21 Parkhouse Road, Ardrossan.

The Sub Committee, having considered the terms of the objection, agreed to grant the application, subject to the following conditions:-

1. That a 2.0m wide service strip must be provided along the northern side of the new road as far as the edge of parking bay No.5. Details of the amended drying area, bin store and reposition of parking bays 1-4 shall be submitted to North Ayrshire Council and agreed in writing prior to work commencing on site and, thereafter, implemented prior to the occupation of any of the residential units hereby approved.


2. That radii at the turning area should be 6.0m.

3. That, prior to the commencement of the development, the applicant shall submit details of the public footway detail at the south-east corner of the site for the prior approval of North Ayrshire Council as Planning Authority.

4. That there shall be no direct drainage connections from the proposed development to the trunk road drainage system.

5. That, prior to the commencement of the development, the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority samples of the proposed external finishes.

6. That, prior to the commencement of the development hereby approved, details of a scheme to treat the surface water arising from the site, in accordance with the principles and practices contained in CIRIA's "Sustainable Urban Drainage Systems Design Manual for Scotland and Northern Ireland 2000", shall be submitted to, and approved by, North Ayrshire Council as Planning Authority. Thereafter, any scheme which may be approved shall be fully implemented prior to the completion of the development and maintained thereafter to the satisfaction of North Ayrshire Council as Planning Authority or any such alternative scheme for the disposal of surface water to be agreed with the Planning Authority.

7. That, notwithstanding the plans hereby approved, a 2m high gate shall be erected and retained at the entrance to the pathway between the side elevation of the proposed end-terraced dwellinghouse and the property at 21 Parkhouse Road and, prior to the commencement of the development, details of the gate shall be submitted for the prior written approval of North Ayrshire Council as Planning Authority.

2.2 N/04/01183/PP: Saltcoats: Site to the Rear of 39 Dalry Road

Robert Ferguson, 18 Well Street, Paisley has applied for planning permission for the erection of a 1½ storey detached dwellinghouse, formation of vehicular access and associated landscaping on a site to the rear of 39 Dalry Road, Saltcoats. A representation has been received from Eileen Dorrian, 58 Middlepart Crescent, Saltcoats.

The Sub Committee, having considered the terms of the representation, agreed to grant the application, subject to the following conditions:-

1. That, prior to the occupation of the dwellinghouse hereby approved, vehicular access to the site shall be provided with a drop kerb footway crossing to be formed as detailed in sections 5.2 and 10.8 and Fig 10.16 of the Roads Development Guidelines.


2. That the first 2 metres of the access, measured from the heel of the footway, shall be hard surfaced in order to prevent deleterious material being carried onto the carriageway and designed in such a way that no surface water shall issue from the access onto the carriageway.

3. That a 2m wide footway shall be constructed along the frontage of the site prior to the occupation of the dwellinghouse.

4. That, prior to the commencement of the development, details of all retaining walls within the site shall be submitted to and agreed in writing by North Ayrshire Council as Planning Authority.

5. That the retaining walls shall be constructed and maintained in accordance with the details agreed under Condition 4, prior to the occupation of the dwellinghouse hereby approved.

6. That, prior to work commencing on site, details of the finished floor levels shall be submitted to, and agreed in writing with, North Ayrshire Council as Planning Authority.

7. That, notwithstanding the plans hereby approved, the window on the north gable at first floor level shall be provided in obscured glazing and thereafter maintained to the satisfaction of the Planning Authority.

8. That, prior to the commencement of the development, the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority samples of the proposed external finishes.

3. Garnock Valley Local Plan Area

3.1 N/04/00843/PP: Dalry: 2 Bleeze Road

Mr & Mrs McNab, 2 Bleeze Road, Dalry have applied for planning permission for the erection of a detached double garage to the side of a dwellinghouse at that address. Objections have been received from James Gairns, 24 Templand Road, Mr & Mrs E MacKintosh, 7 Templand Road and David Macreadie, 30 Templand Road, all Dalry.

The Sub Committee, having considered the terms of the objections, agreed to grant the application, subject to the following conditions:-

1. That the garage hereby approved shall be used only for purposes incidental to the enjoyment of the applicants' dwellinghouse and shall not be used for any purpose associated with the applicants' business or for any purpose which would detract from the amenity of neighbouring residential properties by reason of noise, vibration, smell, fumes, smoke, soot, ash, dust or grit.


2. That the driveway serving the garage shall be 6m in length.

3. That, within 6 weeks of the date of this permission, the unauthorised skip shall be removed from the site and the land reinstated to its former condition to the satisfaction of North Ayrshire Council as Planning Authority.

3.2 N/04/00665/RMA: Dalry: 26 Courthill Street

Property and Asset Development, Unit 5, Blocks A, B and C, Carfin Industrial Estate, Carfin have applied for reserved matters approval for the erection of ten detached dwellinghouses with integral garages and formation of associated roads, footways and landscaping and the felling of 5 trees (Nos 170,171,173,174 and 176 in the survey) within an area covered by North Ayrshire Council (former Hotel De Croft, Courthill Street, Dalry) Tree Preservation Order 2004, at 26 Courthill Street, Dalry.

The Sub Committee agreed, subject to the applicants entering into an agreement in terms of Section 75 of the Town and Country Planning (Scotland) Act 1997 or other arrangement as maybe agreed by the Council to provide for the payment to the Council of a commuted sum to contribute towards the upgrading of play facilities in Dalry Public Park, to grant approval of reserved matters subject to the following conditions:-

1. That, in relation to Condition 1 attached to outline planning permission 03/00138/OPP and prior to the commencement of the development, samples of the proposed tile, the external finishes to the dwelling houses and the paviours for the hard surfaces, shall be submitted for the approval in writing of North Ayrshire Council as Planning Authority.

2. That, in relation to Condition 1 attached to outline planning permission 03/00138/OPP, no development shall take place until there has been submitted to, and approved by, North Ayrshire Council as Planning Authority, a scheme for the landscaping of the site and details of proposals for the management of existing trees and their protection during the course of development. The Landscaping Scheme shall include details of species, planting densities, soil treatment and aftercare and shall be implemented prior to the completion of the development. Any tree which, within a period of five years from planting becomes damaged, is removed or dies shall be replaced in the next planting season with others of a similar size and species unless North Ayrshire Council as Planning Authority gives written consent to any variation.

3. That, in relation to Condition 2 attached to the outline planning permission 03/00138/OPP, the six trees hereby agreed for felling shall be replaced with new heavy standard trees, details of the species and siting to be submitted for the written approval of North Ayrshire Council as Planning Authority within 2 months of the date of this permission and all trees shall be planted prior to the completion of the development. Any tree which, within a period of five years from planting becomes damaged, is removed or dies shall be replaced in the next planting season with others of a similar size and species unless North Ayrshire Council as Planning Authority gives written consent to any variation.

4. That, relation to Condition 1 attached to outline planning permission 03/00138/OPP and prior to the occupation of any of the dwellinghouses and where Council adoption of open space areas is not to be pursued, there shall be submitted for approval of North Ayrshire Council as Planning Authority, details of the proposed factor or management agency and a landscape management plan, including long term design objectives, management responsibilities and maintenance schedules for all open space areas. The landscape management plan shall be carried out as approved and the agreed agency shall only be changed with the consent of the majority of householders and the agreement of North Ayrshire Council as Planning Authority.

5. That, in relation to Condition 4 attached to outline planning permission 03/00138/OPP, the footpath along the frontage of the site with Courthill Street shall be provided prior to the completion of the development.

6. That, in relation to Condition 4 attached to outline planning permission 03/00138/OPP, visibility splays of 2.5 metres by 35 metres in both directions shall be provided and maintained on land within the applicant's control, such that there is no obstruction to visibility above a height of 1 metre measured above the adjacent carriageway level, details of which shall be submitted for the written approval of North Ayrshire Council as Planning Authority. Thereafter, any scheme which may be approved shall be fully implemented prior to the completion of the development and maintained thereafter to the satisfaction of North Ayrshire Council as Planning Authority.

7. That, in relation to condition 1 attached to outline planning permission 03/00138/OPP, all approved site boundary fences or walls and plot divisions shall be erected prior to the occupation of the adjoining dwellinghouse(s).

3.3 N/04/01094/PP: Kilwinning: Glasgow Road: Site to the North of Monkreddan Kennels

Mrs M Robertson, Monkreddan Kennels, Glasgow Road, Kilwinning has applied for planning permission for the erection of a dwellinghouse at the site to the north of Monkreddan Kennels, Glasgow Road, Kilwinning.

The Sub Committee agreed, subject to the applicant entering into an agreement in terms of Section 75 of the Town and Country Planning (Scotland) Act 1997 to limit occupation of the house to a person employed in the Monkreddan Kennels business or a dependant of such a person residing with him or her, to grant the application, subject to the following conditions:-

1. That the proposed drainage arrangements shall be to the satisfaction of SEPA and North Ayrshire Council as Planning Authority and the proposed septic tank and soak-away shall be designed and constructed in accordance with the current Code of Practice BS6297: 1983 which will require the applicant to carry out percolation testing on site to assess the suitability of the sub-soil for effluent disposal.

2. That the surface water drainage shall be excluded from the septic tank and, prior to the commencement of the development, the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority full details of proposals of the disposal of surface water from the development.

3. That any unsuspected contamination which becomes evident during construction shall be brought to the attention of North Ayrshire Council as Planning Authority, together with measures for the disposal of the contaminated material.

4. That the first 6 metres of the access from the public road shall be hard surfaced to prevent deleterious material being deposited onto the public road.

5. That the septic tank shall be sited in such a manner as to allow easy access for emptying by tanker.

6. That, prior to the commencement of the development, the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority exact details of the external finishes to the dwellinghouse.

4. Irvine/Kilwinning Local Plan Area

4.1 N/04/01138/PP: Irvine, Rivergate: Rivergate Shopping Centre

Unicycle LLP/ING Retail Property Fund Britannica, c/o GVA Grimley, Sutherland House, 149 St Vincent Street, Glasgow have applied for planning permission for an extension of the shopping centre, including a new multi-storey car park, revised servicing arrangements, alterations to an existing car park and other associated landscaping/infrastructure works at Rivergate Shopping Centre, Rivergate, Irvine. Objections have been received from Fullarton Parish Church, per David Branch, 3 Lawers Place, Fullarton Tenant Participation Unit, per Margaret G Stewart, 50 Annick Court, both Irvine and from Irvine Community Council.

The Senior Development Control Officer advised the Sub Committee of an additional proposed condition. The Senior Development Control Officer also intimated that references within the report to a further proposed retail development at East Road/Quarry Road, Irvine should be disregarded as the application in question has been withdrawn.

The Sub Committee agreed (a) subject to notification to the Scottish Ministers in terms of the Town and Country Planning (Notification of Applications) (Scotland) Directions 1997, to grant the application subject to the following conditions:-

1. That the development hereby permitted shall be begun before the expiration of three years from the date of this permission.

2. That, prior to the commencement of the development, details of the external appearance and materials for the proposed extension and proposals to extend the external treatment to the existing shopping centre shall be submitted for the written approval of North Ayrshire Council as Planning Authority. Thereafter, any such details, which may be approved, shall be implemented on site to the satisfaction of North Ayrshire Council as Planning Authority.


3 That, prior to the commencement of the development, details of the glazed pedestrian entrance to the proposed development from Fullarton Street and of the external lighting under the bridge at Fullarton Street and at pedestrian routes to Cunninghame House and the railway station, shall be submitted for the written approval of North Ayrshire Council as Planning Authority. Thereafter, any such details which may be approved, shall be implemented on site to the satisfaction of North Ayrshire Council as Planning Authority

4. That, prior to the commencement of the use of the proposed extension hereby approved, all external works shown on drawing number 2250065 (0-)11 Revision 4, including alterations to the road system and the surface car park layout and the formation of bus lay-bys and pedestrian crossings, shall be completed to the satisfaction of North Ayrshire Council as Planning Authority.

5. That internal car park junction sightlines shall be improved by providing 2 metre wide areas of hardstanding at the ends of the car parking isles, to the satisfaction of North Ayrshire Council as Planning Authority.

6. That, prior to the commencement of the use of the proposed extension hereby approved, electronic car park information signing shall be provided at appropriate locations, to be agreed with the Council's Roads Services, for both multi-storey car parks and the surface car park.

7. That the existing puffin crossing at the railway station shall be moved further north, in line with the pedestrian route to the shopping centre, and the size of the adjacent lay-by shall be increased in length to accommodate two buses, together with any necessary accommodation works, all to the satisfaction of North Ayrshire Council as Planning Authority.

8. That the developer shall provide a bus lay-by, as detailed on the approved drawings, on the west side of Fullarton Street underneath the Mall, to the satisfaction of North Ayrshire Council as Planning Authority.

9. That the minimum parking provision for the net internal retail area of 34,567 sq. m. shall be 1486 spaces, and that the surface car park and the two multi-storey car parks shall be available at all times for use by all customers of any shop within the Rivergate Centre as extended, to the satisfaction of North Ayrshire Council as Planning Authority.

10. That the presence of any significant unsuspected contamination which becomes evident during the development of the site shall be brought to the attention of Environmental Health. Thereafter, a suitable investigation strategy as agreed with North Ayrshire Council shall be implemented and any necessary remediation works carried out prior to any further development taking place on the site, all to the satisfaction of North Ayrshire Council as Planning Authority.


11. That, prior to the commencement of the development hereby approved, a flood risk assessment together with any necessary remedial works, and details of a scheme to treat the surface water arising from the site in accordance with the principles and practices contained in CIRIA's "Sustainable Urban Drainage Systems Design Manual for Scotland and Northern Ireland 2000", shall be submitted to, and approved by North Ayrshire Council as Planning Authority. Thereafter, any schemes that may be approved shall be fully implemented prior to the completion of the development and maintained thereafter to the satisfaction of North Ayrshire Council as Planning Authority.

12. That no development shall take place until there has been submitted to and approved by North Ayrshire Council as Planning Authority a scheme of hard and soft landscaping, which shall include details of species, planting densities, soil treatment and aftercare and shall include indications of all existing trees and hedgerows on the land and details of any to be retained, together with measures for their protection in the course of the development.

13. That all planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting season and seeding seasons following the occupation of the buildings or the completion of the development, whichever is the sooner, and any trees or plants which, within a period of five years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of a similar size and species, unless North Ayrshire Council as Planning Authority gives written consent to any variation.

14. That, prior to the commencement of the development, a management plan for car parking within, and public access to, the site during construction shall be submitted for the written approval of North Ayrshire Council as Planning Authority. Thereafter, any such details which may be approved, shall be implemented on site to the satisfaction of North Ayrshire Council as Planning Authority; and

(b) to promote a stopping up order under Section 207 of the Town and Country Planning (Scotland) Act 1977 for the west carriageway of the A737 Fullarton Street, Irvine.

4.2 N/04/01033/PP: Kilmarnock: Kilmaurs: Site to the East of Altonfoot

Kenneth Rice, Altonfoot Cottage, Kilmaurs, Kilmarnock has applied for planning permission for the erection of a shed/tractor shed at the site to the east of Altonfoot, Kilmaurs, Kilmarnock. An objection has been received from Susan Anderson, Altonhead Farm, by Kilmaurs.

The Sub Committee, having considered the terms of the objection, agreed to refuse the application on the following ground:-

1. That the proposed development would be contrary to Policies ENV1 of the Adopted Irvine and Kilwinning Local Plan and Policy ENV1 and the Development Control Statement of the Finalised North Ayrshire Local Plan (excluding Isle of Arran), in that it would represent intrusive development within a countryside area for which no specific need has been demonstrated which would be detrimental to visual amenity and would, if approved, establish an undesirable precedent for other similar developments, to the detriment of the character and appearance of the countryside.

4.3 N/04/01099/PP: Irvine: Site to the West of 1 James Crescent

A Arcaro, 6 Academy Road, Irvine has applied for planning permission for the erection of a building for use as a hot food take-away and a shop at the rear on a site to the west of 1 James Crescent, Irvine. Objections have been received from the 43 parties listed in Annex 1 to the report.

The Sub Committee, having considered the terms of the objections, agreed to refuse the application on the following grounds:-

1. That the proposed hot food shop would be contrary to Policy HOU 5 and to criteria (i) (iv) and (v) in Policy RET 12 in the Adopted Irvine/Kilwinning Local Plan, in that it has not been demonstrated that the quality of the residential amenity would be safeguarded; there is no recognised local demand; the proposal would attract additional traffic from outwith the local area; and the proposal would have a detrimental effect on neighbouring properties by way of noise, disturbance and odours.

2. That the proposed hot food shop would be contrary to criteria (a) and (c) in Policy TC 6 and the Development Control Statement in the Finalised North Ayrshire Local Plan (excluding Isle of Arran), in that there is no recognised local need and it would attract additional traffic from outwith the local area.

3. That the proposed development is deficient in off-street car parking which is necessary to reduce potential traffic congestion.

4.4 N/04/01035/OPP: Irvine: 5A Stanecastle Road: Site to the South of

Leonard Boyd, 5A Stanecastle Road, Irvine has applied for outline planning permission for the erection of a dwellinghouse on a site to the south of 5A Stanecastle Road, Irvine.

The Sub Committee agreed to refuse the application on the following grounds:-

1. That the proposed house would be contrary to criterion (5) in Policy HOU 9 in the Adopted Irvine Kilwinning Local Plan, in that it would be a backland development without a suitable independent access and outlook.

2. That the proposed house would be contrary to the criteria in the Development Control Statement in the Finalised North Ayrshire Local Plan (excluding Isle of Arran), in that it would result in an unsatisfactory backland development which would not be in the interests of the proper planning of the area.


4.5 N/04/01181/PP: Irvine: Site to the East of and 15 Muirfield Court

Mr T Allardice, 15 Muirfield Court, Irvine has applied for planning permission for a change of use of an area of ground to garden ground and the erection of a single storey extension to the side of a detached dwellinghouse at 15 Muirfield Court, Irvine and on a site to the east of that address.

The Sub Committee agreed to refuse the application on the following grounds:-

1. That the proposal would be contrary to criterion (4) of Policy TOU 11 in the Adopted Irvine/Kilwinning Local Plan, in that the change of use to garden ground would set an undesirable precedent for further loss of open space and to criterion (4) in Policy ENV 7, in that it would involve the loss of an area of landscaped structure planting associated with a main transport corridor and housing area.

2. That the proposal would be contrary to criterion 3(b) of Policy OS1 of the Finalised North Ayrshire Local Plan (excluding Isle of Arran), in that it would set an undesirable precedent for further incremental loss of open space.

3. That there is sufficient land and space within the existing garden for an alternative solution which would satisfy the need to provide an extra bedroom and utility room without acquiring additional land outwith the curtilage of the house.

5. North Coast and Cumbraes Local Plan Area

5.1 N/04/01055/CAC: Skelmorlie: 12 Shore Road

Barbara L Armstrong, Woodsley Cottage, 12 Shore Road, Skelmorlie has applied for conservation area consent for the demolition of an outshed to the side of a semi-detached dwellinghouse at that address. An objection has been received from Skelmorlie Community Council, c/o Mrs Elizabeth Walker (Secretary), 57 Innes Park Road, Skelmorlie.

The Sub Committee, having considered the terms of the objection, agreed to grant the application, subject to the following condition:-

1. Notwithstanding the plans hereby approved, the existing east boundary wall on Shore Road shall be retained and any damage to the wall arising from demolition of the south facing wall shall be repaired to the satisfaction of the Planning Authority.

5.2 N/04/00494/PP: Skelmorlie: Eglinton Terrace: Site of 37, 39 Shore Road and site to the East Western Sea Yett and Eastern Sea Yett

Ossian Construction Ltd, 1 Glasgow Road, Paisley have applied for planning permission for the demolition of 4 dwellinghouses, the erection of 40 flats, formation of an access, car parking, erection of a triple garage and associated works at the site of 37, 39 Shore Road and the site to the East Western Sea Yett and Eastern Sea Yett, Eglinton Terrace, Skelmorlie. A total of 55 objections have been received, as listed in Annex 1 to the report, along with 3 petitions of objection with a total of 101 signatories.

The Sub Committee agreed to continue consideration of this application to its next meeting.

6. Provisional Tree Preservation Orders

Submitted reports by the Assistant Chief Executive (Development and Promotion) on the serving of Provisional Tree Preservation Orders at the following locations:-

6.1 Irvine: 20 Townhead

The Sub Committee agreed to approve the action taken to serve a Provisional Tree Preservation Order.

6.2 Largs: Halkshill House

The Sub Committee agreed to approve the serving of a Provisional Tree Preservation Order.
