Smoking in Public Places

The Scottish Government brought new legislation into force on 26th March 2006 prohibiting smoking in enclosed public places.  They had published a programme detailing how they intended to introduce the legislation and sought the assistance of local authority Environmental Health Departments in the build up to the implementation of the legislation.

 

Environmental Health Officers, in the course of their day to day work with the many businesses and licensed premises within North Ayrshire, have ensured that operators are aware of the legislation and the continuing need to take steps to implement it.  To date every premises has been visited to check compliance with the legislation. 

Signage

All no smoking premises must display notices about the ban.  If anyone is smoking these notices will tell you how to report the offence.  If no action is taken then contact us to allow us to investigate.

Every business and organisation in Scotland covered by the new law will need to take all reasonable precautions to ensure that employees, customers and visitors do not smoke on their premises.

Types of Offences

  • An offence by a business not to display no smoking signs in no-smoking premises - £200
  • An offence by businesses to knowingly permit smoking in no-smoking premises - £200
  • An offence by individuals of smoking in no smoking premises - £50
  • If fixed penalties are not paid then individuals could be prosecuted and fined up to £2500
