The Civic Government (Scotland) Act 1982 provides that unless you hold an "Exemption Warrant" you require a Metal Dealer's Licence from North Ayrshire Council for carrying on a business as a Metal Dealer in North Ayrshire. Section 7 states that anyone, who without reasonable excuse, does anything which you need a licence for, without having a licence, will be guilty of an offence liable on summary conviction to a fine not exceeding £2,500.
Exemption Warrants
We are required, on application by a Metal Dealer, to issue an "Exemption Warrant" if there is produced, a Certificate by the auditor of the Metal Dealer's business stating that in a financial year ending in the 18 months prior to the Certificate, the total amount received by the dealer as a principal in ordinary course of his business in respect of metal sold or supplied by him exceeded £100,000. Such a Warrant remains in force for 3 years. If you wish to apply for an Exemption Warrant we will supply you with an appropriate application form.
Temporary Exemption Warrants
We may on application by a Metal Dealer, issue a "Temporary Exemption Warrant" if we are satisfied that the have not been carrying on business as a Metal Dealer. Such a Temporary Warrant remains in force for 18 months and it is a condition of such a Warrant that the dealer will acquire metal only from persons selling or otherwise disposing of it in the course of trade or business. Again, if you wish to apply for an Exemption Warrant we will supply you with an application form.
Metal Dealer Licence
We have fixed the fee for an application at £105 for each premises at or from which metal dealing will be carried on. Licences will normally be for a period of 3 years.
Itinerant Metal Dealers
The fee for an application is £105, licences will normally be for a period of 3 years and will cover trading anywhere in Scotland.
NB a metal dealer's licence is also required for dealing in gold and silver.
