Non-Medicinal Poisons

Who can apply?

Certain household products including things such as cleaning agents, toilet chemicals and garden chemicals contain substances that are classed as 'non-medical poisons'. The Poisons Act 1972 and the Poisons Rules 1982 prohibit the sale of poisons unless the seller is a retail pharmacist or a person who has his name on the local authority's list entitling him to sell poisons from the premises named (a listed seller).

Completed application forms should also be sent to the contact details at the right of this page. The application form should be accompanied by the non refundable fee.

What happens next?

On receipt of the completed documents, the application will be circulated to all consultees listed on the front of the form and some of the consultees will carry out an inspection of the premises (if applicable). It will also be advertised on the Council's website to allow for members of the public to lodge any objections or representations to the issue of the licence.

If there are no objections, the licence will be issued for a period of 1 year from the date of issue.

What if I don't hear from North Ayrshire Council's Licensing Office within the specified time period?

It is in the public interest that North Ayrshire Council must process your application before it can be granted. If you have not heard from the Licensing Office within a reasonable period, please contact us. You can do this using the contact details to the right of this page.

Please note that the application process may take up to 4/5 weeks.

Fees

For 2010/2011 the fee for a Poisons licence is £22. The fee is subject to annual review.

The fee is not returnable if you decide to withdraw the application or if the licence is refused.

What products can I sell if I have a poisons registration?
If you have a poisons licence, you may sell any product containing any chemical listed in part II of the Poisons Order 1982.

What do I have to do once I have a poisons registration?
You must store any poisons safely, that is, either in a separate drawer or cupboard kept only for that purpose, or in part of the premises where customers are not permitted, or on a shelf kept solely for the storage of poisons and no food is kept directly under the shelf.

How long does poisons registration last?
A poisons registration lasts for 12 months.
