Public Notice - Licensing Policy Statement 2010 - 2013
Every 3 years North Ayrshire Licensing Board is required to review and set out their Licensing Policy Statement. The Licensing Policy Statement details the Boards Policies in relation to the Licensing (Scotland) Act 2005.
The following document provides information for members of the public and details how comments can be made on the proposed Licensing Policy Statement 2010 - 2013. Members of the public are invited to make written comments on the proposed Licensing Policy Statement 2010 - 2013, to arrive no later than Friday 30th April 2010.

Standard Conditions Under The Licensing (Scotland) Act 2005
The Standard Conditions are issued in several Editions. This is because they have been reviewed and amended from time to time since they were first adopted. On each occasion, a new Edition is issued.
Only one Edition ever applies to particular Premises. If a Premises Licence was granted with one Edition, it is not affected if the Board later to approves a new Edition. This means that the Board's website requires to maintain several copies of the Standard Conditions, because the earlier Editions continue to be relevant to Premises which had Licences granted earlier.
When the Board informs an Applicant that the Premises Licence Application will be considered at a Meeting on a particular date, the Board also informs the Applicant that any Premises Licence to be granted will be subject to specified Parts of the Standard Conditions. The Applicant should read this as a reference to the most recent Edition.
It is possible that the Board might later want to apply the newest Edition to older Licences, but this is covered by the statutory variation procedure and would involve the individual Licence Holders having the right to make representations to the Board as to whether or not the variation should be applied.
It is possible that the Board may apply additional Conditions, in addition to the Standard Conditions, to deal with the circumstances of particular Premises.
