1. Declarations of Interest

2. Deputations
2.1 07/01076/PP: Largs: Irvine Road: Largs Yacht Haven
The Scottish Sailing Institute, Largs Yacht Haven, Irvine Road, Largs, have applied for planning permission for the formation of the sailing dinghy launching area incorporating reclamation of land, construction of launching beach and removal of rock hazards within the tidal zone at Largs Yacht Haven. Twenty-two letters of objection and five letters of support have been received in relation to the proposed development, as listed in full in Annex 1 to the report.
Maggie Kelly and Tim Cowen, accompanied by John McCracken, all of the Save Pencil Bay Campaign, addressed the Committee in support of the objections. Mrs Kelly asserted that the development would lead to the devastation of an area of natural beauty and, as such, would be contrary to National Planning Guidance (NPPG13) and Local Plan Policies ENV8 (1) and BE5.
She indicated that the planned works would have a detrimental impact on the cultural and historical position of the nearby Category B-listed Pencil Monument and would adversely affect tourism and wildlife. Mrs Kelly expressed concerns about public safety issues surrounding the proposed rock armour adjacent to the new slipway, a lack of publicly accessible, detailed information about the application, and about the failure to undertake an Environmental Impact Assessment in connection with the application. Mr Cowen suggested that the projected economic benefit of the development had been exaggerated by the applicants and expressed concern that no feasibility study had been carried out into the possibility of extending the existing slipway, nor had sufficient consideration been given to alternative sites for the development.
David Kent and John Ridley, of the Scottish Sailing Institute, accompanied by Ian MacKenzie, Consulting Engineer, addressed the Committee in response to the objectors. They emphasised that the development would not devastate the area, no views would be disturbed, the rock armour would be no higher than that surrounding the marina itself and the grassed area proposed would serve to make the beach more accessible. Public consultation arrangements had met the statutory requirements and advice from the Council indicated that there was no need for an Environmental Impact Assessment. They asserted that estimates of the overall economic benefit to be derived from the development were realistic and that it would have a positive impact on tourism in the area. Finally, they confirmed that several other potential locations for the development had been examined, but only the current site provided the position and infrastructure required.
The objectors then responded to statements by the applicants in relation to public safety, economic benefits and public meetings.
The Planning Services Manager then outlined the terms of the report, which recommended that the application be granted subject to referral to Scottish Ministers and to conditions detailed within the Appendix to the report. He also advised of the receipt of a further 2 letters of objection, Jane Wilson, 12 Aubery Crescent and Maureen Muir, 42 Sinclair Drive, both Largs, and responded to the issues contained therein.
Thereafter, Members asked questions of the objectors, applicants and officers. The Committee expressed the view that, if approved, working times should be restricted by condition.
The Committee, having heard the deputation, the applicants and having considered the terms of the objections and letters of support, agreed to grant the application subject to (a) referral to Scottish Ministers and (b) the following conditions unless the Scottish Ministers issue a Direction in response to the referral:-
1. That, prior to the commencement of the development, the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority (i) detailed proposals for the provision and future maintenance of the proposed open space areas, (ii) a detailed report on samples of the proposed infill material to confirm that it is free of contamination, (iii) amended plans to incorporate the provision of a level surfaced pedestrian access path linking the proposed trolley route to the sandy beach at the foot of the slipway, and (iv) proposed arrangements to allow public access via the access control barrier adjacent to the public car park and to restrict unauthorised vehicle access to the launching beach and adjacent open space area.
2. That no construction works shall be carried during the official bathing season which is defined as being on or between 1st June and 15th September.
3. That the applicant shall give adequate prior notice to North Ayrshire Council Roads Authority of any forthcoming major events which are likely to impact on the adjacent public car parks, to the satisfaction of North Ayrshire Council as Planning Authority.
4. That construction work on the site shall only take place between the hours of 08.00 and 18.00 Mondays to Fridays; 09.00 and 13.00 on Saturdays, and no works shall take place on Sundays or Bank Holidays, unless North Ayrshire Council as Planning Authority gives written consent for any variation.
3. Isle of Arran
3.1 07/00753/OPP: Brodick: Pier Brae: Brodick Nursery
The Committee noted that the application submitted by Mr & Mrs C Morrison, Brodick Nursery, Pier Brae, Brodick, Isle of Arran, for outline planning permission for a residential development at Brodick Nursery, had been withdrawn.
4. Ardrossan/Saltcoats and Stevenston
4.1 08/00169/PP: Saltcoats: 7-11 Quay Street and 2 Dockhead Street
LNS Investments Ltd, 113 St George's Road, Glasgow, have applied for planning permission for a change of use, alterations and extensions to vacant retail and storage units to form 13 dwellingflats at 7-11 Quay Street and 2 Dockhead Street, Saltcoats.
The Committee agreed to grant the application subject to (a) the applicants entering into a Section 75 Agreement or other suitable arrangement deemed appropriate by the Council to provide a commuted sum for the provision or upgrading of play facilities in the locality; and (b) the following conditions:-
1. That, prior to the commencement of the development, the applicants shall submit for the written approval of North Ayrshire Council as Planning Authority exact details of (i) all external finishes to the extension, (ii) the surface finish to the car parking and manoeuvring areas and (iii) the design and appearance of the proposed bin storage areas.
2. That, prior to the commencement of the use of the flats hereby approved, the proposed footway on Quay Street shall be widened to approximately 1.6 to 2.2 metres, leaving a carriageway width of 3.5 metres along the extents of the development and, thereafter, the new kerb line shall tie into Dockhead Lane using an appropriate radius and taper into the existing kerb line to the north of the development, all to the satisfaction of North Ayrshire Council as Planning Authority.
3. That, prior to the occupation of any of the flats hereby approved, a minimum service strip of 0.5 metres shall be retained on Dockhead Lane along the full extents of the application site, to the satisfaction of North Ayrshire Council as Planning Authority.
4. That the parking and manoeuvring areas shall be designed in such a way that no surface water shall issue from them on to the public carriageway.
5. That, prior to the commencement of the development hereby approved, details of a scheme to treat the surface water arising from the site in accordance with the principles and practices contained in CIRIA's "Sustainable Urban Drainage Systems Manual", published in March 2007, shall be submitted to, and approved by, North Ayrshire Council as Planning Authority. Thereafter, any scheme which may be approved shall be implemented prior to the completion of the development and maintained thereafter to the satisfaction of North Ayrshire Council as Planning Authority.
5. Garnock Valley
5.1 08/00289/PP: Beith: Threepwood Road: Site to South West of Grangehill
Peter Ross, Grangehill, Threepwood Road, Beith, has applied for retrospective planning permission for the siting of a static caravan for an agricultural worker for a temporary period (2 years) on a site to the south west of Grangehill, Threepwood Road, Beith.
The Committee agreed to grant the application subject to the following condition:-
1. That the caravan hereby permitted shall be removed and the land restored to its former condition on or before 31 May 2010 or the occupation of the dwellinghouse approved under outline planning permission 08/00115/OPP, whichever is the earlier.
5.2 05/01146/ADC: Dalry: Kilwinning Road: Dalry Thistle Football Ground
Dalry Thistle Football Club, per the Secretary, Bernard Rocks, 25 Courthill Street, Dalry, has applied for retrospective advertising consent for the erection of static advertisements board at Dalry Thistle Football Ground, Kilwinning Road, Dalry.
The Committee agreed (a) to refuse the application on the following ground:-
1. That the advertisement signs are contrary to Policy TC8 (Control of Advertisements) in the Adopted North Ayrshire Local Plan (excluding Isle of Arran) and Regulation 4 of the Town and Country Planning (Control of Advertisements) (Scotland) Regulations 1984, in that their location and number detracts from the amenity and setting of the area and constitutes unacceptable advertisement clutter at this location.
and (b) to serve an Enforcement Notice, if necessary, to secure the removal of the signs.
6. Irvine/Kilwinning
6.1 08/00234/PP: Irvine: Former Burnside Cottage
Mr R McGill, 4D Sloan Place, Irvine, has applied for planning permission for the erection of detached dwellinghouse, siting of two temporary storage containers, temporary mobile home and demolition of an existing house at former Burnside Cottage, Irvine.
The Committee agreed (a) to refuse the application of the following ground:-
1. That the proposed development would be contrary to Policies ENV 1 and H 2 in the Adopted North Ayrshire Local Plan (excluding Isle of Arran), in that it would comprise a new dwellinghouse in the countryside for which it has not been demonstrated that there is a genuine operational need for a worker to live on site in pursuance of an established rural business or that the proposal is distinctive and responsive to its setting or makes a positive design contribution to the locality.
and (b) to serve an Enforcement Notice requiring the unauthorised mobile home and storage container to be removed.
6.2 08/00223/PP: Kilwinning: 33 Ashgrove Road
Alistair McLaughlin, 33 Ashgrove Road, Kilwinning, has applied for planning permission for the formation of a dormer extension to the front, alterations to the roof and erection of an extension to the rear of the detached dwellinghouse at that address. An objection has been received from D C Cassidy, 1 Woodside Road, Kilwinning.
The Committee, having considered the terms of the objection, agreed to grant the application subject to the following condition:-
1. That, prior to the commencement of the development, the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority details of the proposed external finishes. For the avoidance of doubt, the dormer walls shall be clad in tiles to match the roof.
6.3 08/00226/PP: Irvine: 90 Waterside
C Daugherty, 90 Waterside, Irvine, has applied for planning permission for the erection of a one-and-a-half-storey extension and formation of decking to the rear of the semi-detached dwellinghouse at that address. An objection has been received from Mr and Mrs William Dore, 92 Waterside, Irvine.
The Committee, having considered the terms of the objection, agreed to grant the application.
6.4 08/00245/PP & 08/00246/ADC: Dreghorn: 5 Corsehill Mount Road: Parks Garage and Showroom
Parks of Hamilton (Holdings) Ltd, Park House, 14 Bothwell Road, Hamilton, have applied for planning permission and advertising consent for (a) a change of use from open space to form part of a car display area, including the erection of a 2.4m high fence, barrier and 3 floodlights; and (b) the erection of 1 freestanding non-illuminated aluminium tower sign and 10 flag masts at Parks Garage and Showroom, 5 Corsehill Mount Road, Dreghorn.
The Committee expressed the view that the width of the footpath should be specified by condition.
The Committee agreed to grant (a) planning permission 08/00245/PP subject to the following conditions:-
1. That the proposed new footpath to the east of the east boundary of the site shall have a minimum width of 2 metres and shall be formed to the satisfaction of North Ayrshire Council as Planning Authority and available for use before the existing footpath across the site is closed to the public.
2. That, prior to the commencement of the development hereby approved, details of the proposals for surface water drainage, including a scheme to treat the surface water arising from the site in accordance with the principles and practices contained in CIRIA's "Sustainable Urban Drainage Systems Manual", published in March 2007, shall be agreed with the Scottish Environment Protection Agency and submitted to, and approved in writing by, North Ayrshire Council as Planning Authority. Thereafter, any such details which may be approved shall be implemented on site to the satisfaction of North Ayrshire Council as Planning Authority.
3. That the presence of any significant unsuspected contamination that becomes evident during the development of the site shall be brought to the attention of Environmental Health. Thereafter, a suitable investigation strategy as agreed with North Ayrshire Council shall be implemented and any necessary remediation works carried out prior to any further development taking place on the site, all to the satisfaction of North Ayrshire Council as Planning Authority.
and (b) Advertisement Consent 08/00246/ADC subject to the following condition:-
1. That the specific duration of advertisement consent is considered expedient having regard to the provisions of Section 18 of the Town and Country Planning (Control of Advertisement) (Scotland) Regulations 1984.
6.5 08/00173/PP: Irvine: 89 Sillars Meadow
William Gamble, 89 Sillars Meadow, Irvine, has applied for planning permission for the erection of an extension to the rear of the detached dwellinghouse at that address. Objections have been received from Janet R Cochrane, no. 87, Kenneth Trainer, no. 83 and Mrs Maureen Hands, no. 85, all Sillars Meadow, Irvine.
The Committee, having considered the terms of the objections, agreed to grant the application.
6.6 07/01043/PP: Irvine: New Street: Riverway Retail Park
Prudential Property Investment Managers Ltd, c/o GVA Grimley LLP, Sutherland House, 149 St Vincent Street, Glasgow, have applied for a Section 42 application: non-compliance with Condition no. 6 of planning permission CH/01/88/0546/L which states that all retail sales shall be located on the ground floor of any unit at Riverway Retail Park, New Street, Irvine. An objection has been received from Muir Smith Evans, 203 Bath Street, Glasgow on behalf of ING Britannica LLP (owners of the Rivergate Centre).
The Committee, having considered the terms of the objection, agreed to grant the application subject to the following conditions:-
1. That Condition 6 of outline planning permission CH/01/88/0546/L shall be substituted by a condition stating "that all retail sales areas shall be located on the ground floor of any unit, with the exception of a single unit of 929 sq. m. (10,000 sq. ft.) (Unit 3) where a full cover trading mezzanine is hereby permitted".
2. That within 9 months of the date of this permission the scheme of kerb re-alignment, pedestrian enhancements and signage shown on approved drawing nos.7242 SK080513-00 and SK080514-00 shall be implemented fully to the satisfaction of North Ayrshire Council as Planning Authority. Any variations to the scheme shall be submitted for the written approval of North Ayrshire Council as Planning Authority prior to implementation.
6.7 08/00097/PP: Irvine: High Armsheugh
Jane Henderson, High Armsheugh, Irvine, has applied for planning permission for the alteration of the existing dwellinghouse and conversion of outbuildings to form 4 dwellinghouses at that address. An objection has been received from Mitchells Robertson, Solicitors and Estate Agents, George House, 36 North Hanover Street, Glasgow on behalf of M.R. and M.T. Quarm, owners of the surrounding farm lands at High Armsheugh Farm, Irvine.
The Committee, having considered the terms of the objection, agreed to grant the application subject to the following conditions:-
1. That, prior to the commencement of the development, the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority full details of the treatment of all external walls.
2. That, notwithstanding the details for Houses C and D hereby approved, amended drawings shall be submitted showing the deletion of the windows serving the toilet and kitchen of House C and the reduction in the width of all the dormers on the east elevation of House D to a 1.2m width, for the approval in writing of North Ayrshire Council as Planing Authority. Thereafter, any such details which may be approved shall be implemented prior to the occupation of the dwellinghouse and to the satisfaction of North Ayrshire Council as Planning Authority.
3. That, prior to the commencement of any works, details of the treatment of all common surfaces shall be submitted for the written approval of North Ayrshire Council as Planning Authority and, thereafter, implemented prior to the commencement of the use hereby approved.
4. That, prior to the commencement of the development hereby approved, details of the boundary fences and a plan of curtilages attached to each dwellinghouse shall be submitted to, and approved in writing by, North Ayrshire Council as Planning Authority. Thereafter, any such details which may be approved shall be implemented prior to the occupation of the dwellinghouse and to the satisfaction of North Ayrshire Council as Planning Authority.
5. That, prior to the commencement of any works, revised details shall be submitted of the access arrangements for the common area located to the north of the steading including arrangements for turning and visitor parking.
6. That, within 3 months of the date of this permission, full details of the proposed landscaping scheme for the common areas which shall include details of species, planting densities, soil treatment and aftercare, shall be submitted for the approval in writing of North Ayrshire Council as Planning Authority.
7. That all planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting season and seeding seasons following the occupation of the buildings or the completion of the development, whichever is the sooner; and any trees or plants which, within a period of five years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of a similar size and species, unless North Ayrshire Council as Planning Authority gives written consent to any variation.
8. That, prior to the occupation of any dwellinghouse, the access road shall be provided with passing place(s) in accordance with a scheme to be submitted and agreed with North Ayrshire Council as Planning Authority.
9. That the presence of any significant unsuspected contamination that becomes evident during the development of the site shall be brought to the attention of Environmental Health. Thereafter, a suitable investigation strategy as agreed with North Ayrshire Council shall be implemented and any necessary remediation works carried out prior to any further development taking place on the site, all to the satisfaction of North Ayrshire Council as Planning Authority.
10. That, prior to the commencement of any works, details of the drainage arrangements including the results of any prior investigation works as required by SEPA, shall be submitted for the written approval of North Ayrshire Council as Planning Authority and the approved details to be implemented prior to the commencement of the use hereby approved.
11. That, prior to the commencement of the development hereby approved, details of a scheme to treat the surface water arising from the site in accordance with the principles and practices contained in CIRIA's "Sustainable Urban Drainage Systems Manual", published in March 2007, shall be submitted to, and approved by North Ayrshire Council as Planning Authority. Thereafter, any scheme that may be approved shall be implemented prior to the completion of the development and maintained thereafter to the satisfaction of North Ayrshire Council as Planning Authority.
12. That, prior to the occupation of the houses, a 2 metre by 3 metre hard standing shall be provided adjacent to the public road for use as a bin pick up point, to the satisfaction of North Ayrshire Council as Planning Authority.
13. That there shall be no communal storage of waste within the common courtyard and all wheeled bins shall be stored within the respective house curtilages.
6.8 08/00146/PP: Kilwinning: 4 Dalry Road
Bennets of Kilwinning, 4 Dalry Road, Kilwinning, have applied for planning permission for the erection of an extension to the funeral parlour to form a garage and staff facilities at that address. A representation has been received from Mrs Mary Barr, 8 Dalry Road, Kilwinning.
The Committee expressed the view that no vehicle repairs should be carried out on site, the garage should be used for funeral cars only, rather than buses, and drainage arrangements should be secured by condition.
The Committee, having considered the terms of the representation, agreed to grant the application subject to the following conditions:-
1. That, prior to the commencement of the development, the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority details of the proposed external finishes.
2. That funeral cars associated with the use shall be parked within the building or on the forecourt hereby approved, and shall neither be parked within the adjoining car park nor the access road, to the satisfaction of North Ayrshire Council as Planning Authority.
3. That the presence of any significant unsuspected contamination that becomes evident during the development of the site shall be brought to the attention of Environmental Health. Thereafter, a suitable investigation strategy as agreed with North Ayrshire Council shall be implemented and any necessary remediation works carried out prior to any further development taking place on the site, all to the satisfaction of North Ayrshire as Planning Authority.
4. That no repairs to vehicles shall be undertaken on the site or within the building to the satisfaction of North Ayrshire Council as Planning Authority.
5. That the site and the building hereby approved shall not be used for the storage of mini buses or buses and shall be used only for the garaging of funeral vehicles.
6. That, prior to the commencement of the development hereby approved, details of the surface drainage arrangements shall be submitted to, and approved in writing by, North Ayrshire Council as Planning Authority. Thereafter, any such details which may be approved shall be implemented prior to the occupation of the building hereby approved and to the satisfaction of North Ayrshire Council as Planning Authority.
7. North Coast and Cumbraes
7.1 07/00896/ADC: West Kilbride: Seamill: 31 Ardrossan Road
Ricky Waugh, 31 Ardrossan Road, Seamill, West Kilbride has applied for retrospective advertising consent for the extension of external illuminated fascia signage to the front of the hotel at that address.
The Planning Services Manager indicated that the officer recommendation in respect of this application was now for approval subject to a condition.
The Committee agreed (a) to grant the application subject to the following condition:-
1. That the display shall be for a period of 5 years from the date of this consent.
and (b) to serve an Enforcement Notice, if necessary, to secure the removal of the unauthorised advertisements.
7.2 08/00150/PP & 08/00151/PP: West Kilbride: Cumbrae Place: Site to the south of 14 Goldenberry Avenue, and site to the east of Bowfield Road
Miller Homes Ltd, Glasgow Business Park, Unit 1125 Parkway Court, 281 Springhill Parkway, Baillieston, Glasgow, have applied for planning permission for the erection of 21 two-storey villas, associated roads, fences and landscaping (Application 08/00150/PP) and for the erection of 14 two-storey residential villas, associated roads, fences, landscaping and two serviced self-build plots (Application 08/00151/PP) on a site to the south of 14 Goldenberry Avenue and site to the east of Bowfield Road, Cumbrae Place, West Kilbride. Letters of representation have been received from West Kilbride Amenity Society, per Norman McGilvray of 20 Well Street, Michael Dench of 26 Kilruskin Drive and F W Baxter of 56 Bowfield Road, all West Kilbride.
The Committee, having considered the terms of the representations, agreed to grant (a) Planning Application 08/00150/PP, subject to the applicants entering into a Section 75 Agreement or other such arrangement deemed appropriate by the Council to provide a commuted sum for the provision or upgrading of play facilities in the locality, provided that such an arrangement has not already been made in respect of an earlier permission relating to this site, and subject to the following conditions:-
1. That, prior to the commencement of the development hereby approved, the applicant shall submit written evidence to North Ayrshire Council as Planning Authority of Scottish Water's acceptance of the applicants proposals for the drainage of the application site.
2. That, prior to the commencement of the development hereby approved, the developer shall submit for the written approval of North Ayrshire Council as Planning Authority full details of the proposed external finishes, boundary fencing, feature walls, retaining walls, driveway and path surfaces. Thereafter, any such details which may be approved shall be implemented and thereafter maintained to the satisfaction of North Ayrshire Council as Planning Authority.
3. That no development shall take place until there has been submitted to,, and approved by, North Ayrshire Council as Planning Authority a scheme of landscaping, which shall include details of species, planting densities, soil treatment and aftercare and shall include indications of all existing trees and hedgerows on the land and details of any to be retained together with measures for their protection in the course of the development.
4. That all planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting season and seeding seasons following the occupation of the buildings or the completion of the development, whichever is the sooner; and any trees or plants which, within a period of five years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of a similar size and species, unless North Ayrshire Council as Planning Authority gives written consent to any variation.
5. That, prior to the occupation of any of the dwellinghouses, and where Council adoption of open space areas is not to be pursued, there shall be submitted for approval of North Ayrshire Council as Planning Authority, details of the proposed factor or management agency and a landscape management plan, including long term design objectives, management responsibilities and maintenance schedules for all open space areas. The landscape management plan shall be carried out in accordance with the approved details unless the prior written approval of North Ayrshire Council as Planning Authority is obtained for any variation, and the agreed agency shall only be changed with the agreement of North Ayrshire Council as Planning Authority.
6. That the first 2 metres of the driveways, measured from the heel of the footway shall be hard-surfaced in order to prevent deleterious material being carried onto the carriageway and designed in such a way that no surface water shall issue from the access onto the carriageway.
7. That, prior to the commencement of the development hereby approved, a plan illustrating finished ground levels and finished floor levels shall be submitted for the written approval of North Ayrshire Council as Planning Authority. For the avoidance of doubt, no part of the site shall be developed above existing ground levels. All rear garden areas shall have a minimum of 80 square metres of level ground which shall be provided at the rear of each dwellinghouse. Thereafter, the development shall be implemented in accordance with the details as may be approved to the satisfaction of North Ayrshire Council as Planning Authority.
and (b) Planning Application 08/00151/PP, subject to the applicants entering into a Section 75 Agreement or other such arrangement deemed appropriate by the Council to provide a commuted sum for the provision or upgrading of play facilities in the locality, provided that such an arrangement has not already been made in respect of an earlier permission relating to this site, and subject to the following conditions:-
1. That, prior to the commencement of the development hereby approved, the applicant shall submit written evidence to North Ayrshire Council as Planning Authority of Scottish Water's acceptance of the applicants proposals for the drainage of the application site.
2. That, prior to the commencement of the development hereby approved, the developer shall submit for the written approval of North Ayrshire Council as Planning Authority full details of the proposed external finishes, boundary fencing, feature walls, retaining walls, driveway and path surfaces. Thereafter, any such details, which may be approved shall be implemented and thereafter maintained to the satisfaction of North Ayrshire Council as Planning Authority.
3. That no development shall take place until there has been submitted to, and approved by, North Ayrshire Council as Planning Authority a scheme of landscaping, which shall include details of species, planting densities, soil treatment and aftercare and shall include indications of all existing trees and hedgerows on the land and details of any to be retained together with measures for their protection in the course of the development.
4. That all planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting season and seeding seasons following the occupation of the buildings or the completion of the development, whichever is the sooner; and any trees or plants which, within a period of five years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of a similar size and species, unless North Ayrshire Council as Planning Authority gives written consent to any variation.
5. That, prior to the occupation of any of the dwellinghouses and where Council adoption of open space areas is not to be pursued, there shall be submitted for approval of North Ayrshire Council as Planning Authority, details of the proposed factor or management agency and a landscape management plan, including long term design objectives, management responsibilities and maintenance schedules for all open space areas. The landscape management plan shall be carried out in accordance with the approved details unless the prior written approval of North Ayrshire Council as Planning Authority is obtained for any variation, and the agreed agency shall only be changed with the agreement of North Ayrshire Council as Planning Authority.
6. That the first 2 metres of the driveways, measured from the heel of the footway shall be hard surfaced in order to prevent deleterious material being carried onto the carriageway and designed in such a way that no surface water shall issue from the access onto the carriageway.
7. That, prior to the commencement of the development hereby approved, a plan illustrating finished ground levels and finished floor levels shall be submitted for the written approval of North Ayrshire Council as Planning Authority. For the avoidance of doubt, no part of the site shall be developed above existing ground levels. All rear garden areas shall have a minimum of 80 square metres of level ground which shall be provided at the rear of each dwellinghouse. Thereafter, the development shall be implemented in accordance with the details as may be approved to the satisfaction of North Ayrshire Council as Planning Authority.
7.3 08/00238/PP: West Kilbride: 9 Jacks View
Mr and Mrs M Welsh, 9 Jacks View, West Kilbride, have applied for planning permission for the erection of an extension to the rear of the detached house at 9 that address. A letter of representation has been received from Elizabeth Moran, 13 Jacks View, West Kilbride.
The Committee, having consider the terms of the representation, agreed to grant the application.
7.4 08/00067/PP: Largs: 111 Glen Avenue
Gary McNicol, 111 Glen Avenue, Largs, has applied for retrospective planning permission for the erection of a 1.8m high fence and raised decking area to the rear of detached dwellinghouse at that address. Two objections have been received from Frederick and Anne Monaghan of 113 Glen Avenue and David A Brown of 109 Glen Avenue, both Largs.
The Committee, having considered the terms of the objections, agreed to grant the application subject to the following conditions:-
1. That, notwithstanding the plans hereby approved, the existing fence along the west side of Glen Avenue shall be removed to the satisfaction of North Ayrshire Council as Planning Authority within 6 months of the date of approval. The replacement fence shall be of vertical boarded design, the length of which shall correspond with that illustrated in the approved plans, and shall be erected a minimum of 2 metres back from the heel of the public footway on the west side of Glen Avenue adjacent to the application site. In addition, air gaps of not less than 3 cm shall be provided between each vertical fence board, all to the satisfaction of North Ayrshire Council as Planning Authority.
2. That, notwithstanding the plans hereby approved, the length of fence alongside the cul-de-sac to the north of the site shall be removed to the satisfaction of North Ayrshire Council as Planning Authority within 6 months of the date of approval. The replacement fence shall be of vertical boarded design, the length of which shall correspond with that illustrated in the approved plans, and shall be erected a minimum of 0.5 metres back from the road kerb on the south side of the cul-de-sac leading from Glen Avenue adjacent to the application site. In addition, air gaps of not less than 3 cm shall be provided between each vertical fence board, all to the satisfaction of North Ayrshire Council as Planning Authority.

Mr and Mrs J Lalor, 10 Arranview Gardens, Seamill, West Kilbride, have applied for planning permission for the erection of an extension to the side of the detached dwellinghouse at that address. Two objections have been received from Mr & Mrs V McBride, no. 5 and Mrs P Gillies, no. 3, both Arranview Gardens, Seamill, West Kilbride.
The Planning Services Manager referred to the receipt of two further objections from Margaret and William Jardine, no. 4 and Mr RJ and Mrs MG Killen, no. 6, both Arranview Gardens, West Kilbride, and responded to the issues contained therein.
The Committee, having considered the terms of the objections, agreed to grant the application subject to the following conditions:-
1. That the external finishes to the extension shall match those of the existing dwellinghouse, to the satisfaction of North Ayrshire Council as Planning Authority.
2. That the garage hereby approved, shall be used only for purposes incidental to the enjoyment of the dwellinghouse.
3. That, prior to the commencement of development, the applicant shall submit details of any protection measures for the existing sewer and details of maintaining access to the sewer, to be agreed and approved in writing by North Ayrshire Council as Planning Authority.
