Acre Developments Limited, 47 Bank Street, Irvine, have applied for planning permission to erect 70 private dwellinghouses, with associated garages, parking and new access road, at Dykesmains Phase 4, Saltcoats. Objections have been received from Mr W Keith, 21 Knock Jargon Court, Mrs A Pirrie, 23 Knock Jargon Court and D. R. MacDonald, 1 Corsankell Wynd, all of Saltcoats.
The Sub-Committee having considered the terms of the objections, agreed to grant the application, subject to the following conditions:-
(1) That prior to any development on Phase B as shown on the plans submitted on the application the applicant shall;
(a) carry out a flood risk assessment and submit it to North Ayrshire Council as planning authority;
(b) submit details of numbers, siting, design, external appearance, landscaping and means of access for its residential development, which details shall fully address all issues arising from the flood risk assessment, for the written approval of North Ayrshire Council as planning authority; and
(c) carry out neighbour notification to the satisfaction of North Ayrshire Council as planning authority relative to item (b) above on submission of those details.
(2) That no development shall take place until there has been submitted to and approved by North Ayrshire Council as planning authority a scheme of landscaping, which shall include details of species, planting densities, soil treatment and aftercare and shall include indications of all existing trees and hedgerows on the land and details of any to be retained together with measures for their protection in the course of the development.
(3) That prior to the occupation of any of the dwellinghouses and where Council adoption of open space areas is not to be pursued, there shall be submitted for approval of North Ayrshire Council as planning authority, details of the proposed factor or management agency and a landscape management plan, including long term design objectives, management responsibilities and maintenance schedules for all open space areas. The landscape management plan shall be carried out as approved and the agreed agency shall only be changed with the consent of the majority of householders and the agreement of North Ayrshire Council as planning authority.
(4) That all planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting season and seeding seasons following the occupation of the buildings or the completion of the development, whichever is the sooner; and any trees or plants which, within a period of five years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of a similar size and species, unless North Ayrshire Council as planning authority gives written consent to any variation.
(5) That prior to the commencement of the development the applicant shall submit for the written approval of North Ayrshire Council as planning authority full details of the proposed external finishes.
(6) That footways to adoptable standards shall be constructed to connect the site to the adjacent Phases 6 and 9 of the overall development site to the satisfaction of North Ayrshire Council as planning authority.
(7) That the first 2 metres of the accesses, measured from the heel of the footway shall be surfaced in order to prevent deleterious material being carried onto the carriageway and designed in such a way that no surface water shall issue from the access onto the carriageway.
(8) That the proposed road hump fronting plot 52 shall be repositioned to a point midway between the driveways to plots 53 and 52 which will require the dwellinghouse on plot 64 to be repositioned on the site to avoid conflict between its driveway and the repositioned road hump. Full details of the proposed resiting of the dwellinghouse on plot 64 shall require to be submitted for the written approval of North Ayrshire Council as planning authority prior to the commencement of the development hereby approved.
2. Arran Local Plan Area
(a) N/00/00121/PP: Lamlash: Plot 4 Monamore Burn
Mr C Davidson, Taigh na Traghad, Cordon, Lamlash has applied for planning permission to erect a detached dwellinghouse at Plot 4 Monamore Burn, Lamlash. Objections have been received from Mr T McArthur, Burnside, Cordon, Lamlash, Mr T B Mundy, Alt-a-Mhonaidh, Cordon, Lamlash and Maclay Murray and Spens, Solicitors, 3 Glenfinlas Street, Edinburgh
The Sub-Committee having considered the terms of the objections, agreed to grant the application subject to (a) the conditions detailed in the report; and (b) two further conditions, 13 and 14, which were included to protect the amenity of the area:-
(1) That access to the shared surface road shall be via a ramp transition detail in accordance with the Roads Development Guide, to the satisfaction of North Ayrshire Council as planning authority.
(2) That the access radii shall be 4.5 metres at the junction with the Cordon Road.
(3) That prior to the occupation of the dwellinghouse the new road, which shall be 5.5 metres wide, shall be surfaced in block paving, details of the type and colour of which shall be submitted for the written approval of North Ayrshire Council as planning authority prior to the commencement of the development.
(4) That the service strip shall be 2 metres wide.
(5) That the dimensions of the turning area shall be in accordance with the Roads Development Guide, to the satisfaction of North Ayrshire Council as planning authority.
(6) That the angular changes in horizontal alignment within the road layout shall be eased by use of a suitable radius, to the satisfaction of North Ayrshire Council as planning authority.
(7) That visibility splays of 2.5 metres by 35 metres at the junction with Cordon Road shall be provided and maintained on land within the applicant’s control, such that there is no obstruction to visibility above a height of 1.05 metres measured above the adjacent carriageway level to the satisfaction of North Ayrshire Council as planning authority.
(8) That all the housing plots shall have a minimum parking provision of 2 spaces and shall have a minimum driveway length in front of garages of 6 metres.
(9) That the first 2 metres of each driveway shall be hardsurfaced and designed in such a way that no surface water shall issued onto the roadway.
(10) That effluent disposal arrangements shall comply with the current code of practice BS 6297: 1983 with surface water excluded from the septic tank, to the satisfaction of North Ayrshire Council as planning authority.
(11) That prior to the commencement of the development the applicant shall submit for the written approval of North Ayrshire Council as planning authority details of the proposed roofing material and of the type and construction of the armour stone along the shore.
(12) That the proposed development shall accommodate any existing rights of way to the foreshore and play area.
(13) That prior to the commencement of the development the applicant shall submit for the written approval of North Ayrshire Council as planning authority details of the infill material to be used to reclaim land along the east boundary of the site behind the proposed armour store.
(14) That the Southern boundary of the site and access road shall be enclosed by a hedge, of a type and species to be agreed in writing with North Ayrshire Council as planning authority, in the first planting season following the occupation of the dwellinghouse or the completion of the development, whichever is the sooner; and any plants which, within a period of five years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of a similar size and species, unless North Ayrshire Council As planning authority gives written consent to any variation.
(b) N/00/00268/OPP: Whiting Bay: Site to the North of Seawinds
Mr and Mrs D McNicol, 2 Crawfurds View, Lochwinnoch have applied for outline planning permission to erect a dwellinghouse at the site to the north of Seawinds, Whiting Bay, Isle of Arran. Objections have been received from J. A. McNeish, St. Leonards, Sandbraes, A. Hodge, Sprindrift, Sandbraes, both Whiting Bay, and the Whiting Bay and Kildonan Church.
The Sub-Committee having considered the terms of the objections, agreed to refuse the application on the following grounds:-
(1) That the proposed development would be contrary to Policy HOU5 in the adopted Isle of Arran Local Plan in that it would constitute new residential development in the countryside for which neither an identified occupational need nor any unique justified need has been demonstrated.
(2) That the proposed development would set an undesirable precedent for further development on the shore side of the road.
(3) That the proposed development would be detrimental to the amenity and appearance of the area in that it would be out of character with the amenity area associated with the beach.
(c) N/00/00272/PP: Whiting Bay: Island House: Coffee Pot
C. Ritchie, Coffee Pot, Island House, Whiting Bay has applied for planning permission for a side extension to form a dry goods store at that address.
The Sub-Committee agreed to grant the application.
3. Irvine/Kilwinning Local Plan Area
(a) N/00/00027/OPP: Irvine Lochlibo Road, 1 Doura Mains
Mr H Lynch, 1 Doura Mains, Lochlibo Road, Irvine has applied for outline planning permission to erect 3 holiday chalets at that address. An objection has been received from Mr J Waddell of Bank End Cottage, Doura, Irvine.
The Sub-Committee agreed to refuse the application on the following grounds:-
(1) That the proposal would be contrary to the provisions of the adopted Irvine/Kilwinning Local Plan in that the development is in an isolated location in the Countryside and would detract from the amenity of the Countryside in the vicinity of the site.
(2) That the proposal would be contrary to the provisions of Policy TOU2 of the finalised Irvine/Kilwinning Local Plan, in that its prominent location would detract from the amenity of the Countryside in the vicinity of the site.
(3) That if granted, the proposal would set a damaging precedent for further such developments in prominent locations which would reduce the openness of the Countryside and thereby detract from the amenity it affords.
(b) N/00/00170/PP: Irvine: Hepburn Way: Public Roadway
Ferns Residents’ Association have applied for planning permission to form speed control measures consisting of three speed humps to tarred roadway and one speed hump to shared surface (block paved roadway) at the public roadway, Hepburn Way, Irvine. Objections have been received from Mr P Toner, 27 Hepburn Way, Mr T Law, 23 Hepburn Way and Mr T Peat, 26 Hepburn Way, all of Irvine.
The Sub-Committee having considered the terms of the objections, agreed to grant the application, subject to the following condition:-
(1) That all warning road signs as specified on drawings A3350/01 and /02 shall be erected prior to any of the road and speed humps being operational.
(c) N/00/00202/PP: Springside: 16 Main Road
D. McKee, 16 Main Road, Springside has applied for planning permission to erect a side extension to form two bedrooms, a shower room and an en-suite bathroom at that address. A representation has been received from J Campbell on behalf of Messrs A & A S Dunlop, Corsehill Farm, Springside.
The Sub-Committee having considered the terms of the representation, agreed to grant the application.
4. West Kilbride: Barony Church
Submitted report by the Assistant Chief Executive (Legal and Regulatory) on the outcome of a prosecution for non compliance with a Listed Building Enforcement Notice served on Mr James Bunting in respect of the removal of stained glass windows from the Barony Church, West Kilbride.
The matter was referred to the Procurator Fiscal for prosecution in 1997 following Mr Bunting’s failure to comply with the terms of the Enforcement Notice. Following a number of delays the case came before Kilmarnock Sheriff Court in January 2000 when Mr Bunting pled guilty. On 5th June 2000 Mr Bunting was fined £7000.
