1. Arran Local Plan Area
1.1 N/03/00812/LBC: Lamlash: 21 Hamilton Terrace
Douglas I. Campbell, Craigends, Waterside, Kilmarnock, has applied for Listed Building Consent for the installation of replacement windows at 21 Hamilton Terrace, Lamlash, Isle of Arran. An objection has been received from John Roberts, Arran Civic Trust, 3 Glen Place, Brodick, Isle of Arran.
The Sub Committee, having considered the terms of the objection, agreed (a) to refuse the application on the following grounds:-
1. That the proposed development would be contrary to policy ENV6 of the Isle of Arran Local Plan and policies BE1, BE 4 and the Development Control Statement of the Finalised Isle of Arran Local Plan in that the proposed replacement windows by reason of their material, section sizes, detailing and opening method would detract from the appearance and character of the listed building and the Lamlash Conservation Area;
and (b) in view of the listed significance of this group of buildings (Category A), to authorise a full investigation into the alterations to other buildings within this group with a view to seeking enforcement action.
1.2 N/03/01024/PP: Kings Cross: Pointhouse
Mr. R.F. Haddow, Pointhouse, Kings Cross, Isle of Arran, has applied for planning permission for the conversion and extension of the existing garage into a dwellinghouse at that address. An objection has been received from Mr. and Mrs. Gaw, Ferryway, Kings Cross, Isle of Arran.
The Sub Committee agreed to continue consideration of the application to a future meeting to allow a site familiarisation visit to take place.
2. Ardrossan, Saltcoats and Stevenston Local Plan Area
2.1 N/03/00379/OPP: Saltcoats: High Road: Tesco Stores Ltd.
Tesco Stores Ltd., Cirrus Building, Shire Park, Welwyn Garden City, Herts, has applied for outline planning permission for the erection of a supermarket and the formation of associated car parking, access, servicing and landscaping at Tesco Supermarket, High Road, Saltcoats. Objections have been received from Persimmon Homes, 77 Bothwell Road, Hamilton, Clydeport plc., per MacInally Associates, Planning Consultants, Glasgow, Saltcoats Development Association, per Mr. J. Baxter (Chairman), 6 Berchem Place, Saltcoats, Safeway Stores Ltd., per D.T.Z. Pieda, Consulting, Edinburgh, Scottish Enterprise Ayrshire, 17/19 Hill Street, Kilmarnock; and Mr. R. Boyce, 97 High Road, Stevenston. Representations in support of the application have also been received from USDAW (Union of Shop, Distributive and Allied Workers), 118 Willmslaw Road, Manchester, Mrs. P. Alexander and Mrs. E. Blackman, both c/o Tesco, Saltcoats. A petition of 1521 signatures in support of the proposal has also been received per Tesco Stores Ltd.
The Planning Services Manager set out the terms of the report which recommended that the application be refused on the following grounds:-
1. That the proposed development is contrary to Policies L8 and L9 of the Ayrshire Joint Structure Plan in that it is considered to adversely affect the viability and vitality of Ardrossan and Stevenston town centres.
2. That the proposed development fails to comply with the criteria of Policy COM8 of the Adopted Ardrossan, Saltcoats and Stevenston Local Plan and Policy TC5 of the Finalised North Ayrshire Local Plan (excluding Isle of Arran) in relation to the provision of new shopping facilities and accordingly does not conform to either Plan.
3. That the applicant has failed to satisfactorily demonstrate a justification for a departure from the Development Plan in order to allow an out of town centre retail development.
The Sub Committee, having considered the terms of the objections and the representations in support of the development, agreed, subject to notification to the Scottish Ministers in terms of the Town and Country Planning (Notification of Applications) (Scotland) Direction 1997, as amended by the Town and Country Planning (Notification of Applications) (Scotland) Amendment Direction 1998, to grant the application subject to the following conditions:-
1. That the approval of North Ayrshire Council as Planning Authority with regard to the siting, design and external appearance of, landscaping and means of access to the proposed development shall be obtained before the development is commenced.
2. That prior to the commencement of the development a Green Travel Plan (GTP) has been submitted to and approved in writing by the Planning Authority in consultation with the Scottish Executive Transport and Lifelong Learning Department - Trunk Road Network Management Division (SEETLLD-TRNMD). The GTP will identify measures to be provided, in particular public transport to and from the site, the system of management, monitoring, review, reporting and the duration of the plan.
3. That prior to the commencement of the development the design of the new site access junction with the A78 trunk road must be agreed with the Local Authority in consultation with SEETLLD-TRNMD and the scheme implemented in accordance with the requirements of the Design Manual for Roads and Bridges prior to the commencement of trading.
4. That prior to the commencement of the use of the supermarket the applicant shall (i) improve the bus stop facility on the south side of High Road, opposite the application site, by (a) forming a raised bus boarder and (b) providing a bus shelter, both of which will require the prior approval of North Ayrshire Council Roads Services; (ii) provide a bus shelter at the proposed new bus stop; and (iii) provide a new section of footway across an area of open grass opposite the position of the proposed signal controlled pedestrian crossing on the south side of the A78 trunk road and which shall incorporate pedestrian guardrails at either end.
5. That the proposed bus layby shall incorporate a 20m entry taper, a 12m bay, and a 20m exit taper.
6. That the surface water arising from the site shall be treated in accordance with the principles and practices contained in CIRIA's "Sustainable Urban Drainage Systems Design Manual for Scotland and Northern Ireland 2000" to the satisfaction of North Ayrshire Council as Planning Authority.
7. That no development shall take place within the application site until the developer has secured the implementation of a programme of archaeological work in accordance with a written scheme of investigation to be submitted by the developer, agreed by West of Scotland Archaeology Service, and approved by North Ayrshire Council as Planning Authority. Thereafter the developer shall ensure that the programme of archaeological works is fully implemented and that all recording and recovery of archaeological resources within the development site is undertaken to the satisfaction of North Ayrshire Council as Planning Authority in agreement with the West of Scotland Archaeology Service.
The Sub Committee further agreed that the detailed reasons for the departure from the Ayrshire Joint Structure Plan shall be agreed by the Chair in consultation with the Assistant Chief Executive (Legal and Protective).
2.2 N/03/00854/PP: Saltcoats: Site at the junction of Links Road and McGillivray Avenue
Cunninghame Housing Association, 82-84 Glasgow Street, Ardrossan, have applied for planning permission for the erection of 2 semi detached dwellinghouses, 14 terraced dwellinghouses and 8 flatted dwellinghouses and for the formation of associated roads, footways, car parking spaces and landscaped areas on a site at the junction of Links Road and McGillivray Avenue, Saltcoats. Objections have been received from L. McGhie-Elliott, no. 1, Mrs. J. MacIntyre, no. 3 and Ms. J. Elliott, no. 5 Saughtree Avenue, Saltcoats.
The Sub Committee, having considered the terms of the objections, agreed to grant the application subject to the following conditions:-
1. That prior to the commencement of the development the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority a drainage impact assessment for the proposed development.
2. That prior to the commencement of the development the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority full details of the proposed external finishes and boundary enclosures.
3. That the surface water arising from the site shall be treated in accordance with the principles and practices contained in CIRIA's "Sustainable Urban Drainage Systems Design Manual for Scotland and Northern Ireland 2000" to the satisfaction of North Ayrshire Council as Planning Authority.
4. That visibility splays of 2.5m x 60m shall be provided and maintained on land within the applicant's control, such that there is no obstruction to visibility above a height of 1.05 metres measured above the adjacent carriageway level to the satisfaction of North Ayrshire Council as Planning Authority.
5. That the width of the two driveways on either side of the proposed vehicle access from Links Road shall be increased to 3.5m to the satisfaction of North Ayrshire Council as Planning Authority.
6. That the new accesses and driveways shall be designed in such a way that no surface water issues onto the public road.
3. Garnock Valley Local Plan Area
3.1 N/03/00940/PP: Kilbirnie: 9-11 Craighouse Square
Susan Gillies, t/a Site Solutions, 67 Gateside Street, West Kilbride, has applied for planning permission for the erection of 2 semi detached dwellinghouses at 9-11 Craighouse Square, Kilbirnie. An objection has been received from Robert Muir, 13 Craighouse Square, Kilbirnie.
The Sub Committee, having considered the terms of the objection, agreed to grant the application subject to the following conditions:-
1. That prior to the commencement of the development the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority full details of: i) the proposed external finishes to the dwellinghouses; and ii) the surface finish to the proposed access, turning and parking areas.
2. That no development shall take place until there has been submitted to and approved by North Ayrshire Council as Planning Authority a scheme of landscaping, which shall include details of species, planting densities, soil treatment and aftercare and shall include indications of all existing trees and hedgerows on the land and details of any to be retained together with measures for their protection in the course of the development.
3. That all planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting season and seeding seasons following the occupation of the buildings or the completion of the development, whichever is the sooner; and any trees or plants which, within a period of five years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of a similar size and species, unless North Ayrshire Council as Planning Authority gives written consent to any variation.
4. That prior to the commencement of the development the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority a revised block plan showing the provision of two parking spaces within the curtilage of each plot and a turning area to enable vehicles to enter and leave the site in a forward gear.
5. That prior to the occupation of any of the houses hereby approved, the access, turning area and parking spaces for the proposed houses shall be provided to the satisfaction of North Ayrshire Council as Planning Authority.
6. That the finished floor level of the proposed houses shall be set at least 500mm above existing ground level and prior to the commencement of the development the applicants shall submit for the written approval of North Ayrshire Council as Planning Authority details of the existing ground level and the proposed finished floor levels.
7. That prior to the commencement of the development the applicants shall submit for the written approval of North Ayrshire Council as Planning Authority details of the proposed means of enclosure along the edges of the site.
8. That notwithstanding the permission granted by Article 3 of and Class 7 of Part 2 of Schedule 1 of the Town and Country Planning (General Permitted Development) (Scotland) Order 1992 (or any Order revoking or re-enacting that Order) the express approval of North Ayrshire Council as Planning Authority shall be required in respect of any gates, fences, walls, or other means of enclosure within the curtilage of the dwellinghouses.
3.2 N/03/01157/OPP: Kilbirnie: Glengarth
Messrs. T.R.C. Logan, Holehouse Farm Kilbirnie, have applied for outline planning permission for the erection of a dwellinghouse for an agricultural worker at Glengarth, Kilbirnie.
The Sub Committee agreed to grant the application subject to (a) the applicants entering into an agreement in terms of Section 75 of the Town and Country Planning (Scotland) Act 1997 to limit occupation of the house to a person solely or mainly employed, or last employed, in the locality in agriculture as defined in Section 277 of the Town and Country Planning (Scotland) Act 1997 or in forestry, or a dependent of such a person residing with him or her or a widow or a widower of such a person; and (b) the following conditions:-
1. That the approval of North Ayrshire Council as Planning Authority with regard to the siting, design and external appearance of, landscaping and means of access to the proposed development shall be obtained before the development is commenced.
2. That the design and appearance of the proposed dwellinghouse shall accord with the Council's approved design guidance for buildings in rural areas.
3. That vehicular access shall be provided at the mid point of the site frontage to the public road or the access road along the north boundary of the site and if access is to be taken from the public road, visibility splays of 2.5 metres by 60 metres shall be provided and maintained on land within the applicants control, such that there is no reduction to visibility above a height of 1.05 metres measured above the adjacent carriageway level, to the satisfaction of North Ayrshire Council as Planning Authority.
4. That a turning area shall be provided within the confines of the site in order that the vehicles may enter and leave the site in forward gear.
5. That prior to its occupation, the proposed house shall be provided with a mains water supply.
6. That all drainage arrangements shall be to the satisfaction of SEPA and North Ayrshire Council as Planning Authority and the septic tank and soakaway shall be designed and constructed in accordance with the current Code of Practice BS6297:1983.
7. That surface water drainage shall be excluded from the septic tank.
8. That the septic tank shall be located in such a position as will enable it to be emptied by road tanker.
4. Irvine/Kilwinning Local Plan Area
4.1 N/03/00868/PP: Irvine: 18 Bank Street
Night Entertainment Ltd., c/o 27 James Clements Close, Kilwinning, have applied for planning permission for the change of use from a vacant cinema to form a Nightclub and Public Bar incorporating alterations to the front and the formation of a fire escape to the rear of 18 Bank Street, Irvine. An objection has been received from Messrs. Murray, Gillies and Wilson on behalf of Mr. and Mrs. A. Dunlop, 20B Bank Street, Irvine.
The Sub Committee, having considered the terms of the objection, agreed to grant the application subject to the following conditions:-
1. That prior to the commencement of the use,hereby approved, details of any external flue to be used for the extraction of cooking odours and the storage area for wheeled bins shall be submitted for the written approval of North Ayrshire Council as Planning Authority and the approved details shall be implemented prior to the commencement of the use hereby approved.
2. That prior to the commencement of the use hereby approved the work relating to the upgrading of the insulation of doorways, doorsets, ventilation holes, wall linings and roof structure as detailed and recommended in Section 5.0 (Comments and Recommendations) of the Noise Assessment Report shall be implemented to the satisfaction of North Ayrshire Council as Planning Authority.
3. That on completion of the works required by condition (2) a sound test shall be carried out and a maximum acceptable night club noise level shall be established which is agreeable to North Ayrshire Council as Planning Authority, which level shall not be exceeded during the operations of the night club.
4. That any amplified music in the foyer area shall not exceed a level of LAeq65dB.
5. That a grease trap shall be provided on the drainage system within the premises prior to any discharge of foul water to the public sewer.
6. That the existing nib on the footway outside the premises shall be altered and a guard rail erected to a design and specification and timetable to be agreed with Roads Services and North Ayrshire Council as Planning Authority.
4.2 N/03/01087/OPP: Kilwinning: 21 St. Winning's Road
Matt Palmer, 21a St. Winning's Road, Kilwinning, has applied for outline planning permission for the erection of a dwellinghouse at that address. An objection has been received from Ian Boyd, 19 St. Winning's Road, Kilwinning.
The Sub Committee, having considered the terms of the objection, agreed to refuse the application on the following grounds:-
1. That the proposed development would be contrary to Policies HOU5 and HOU9 of the Adopted Irvine and Kilwinning Local Plan and the Development Control Statement of the Finalised North Ayrshire Local Plan (excluding Isle of Arran) in that: (i) the proposed development would constitute backland development which would be detrimental to the amenity and privacy of the adjoining residential properties; (ii) it would represent overdevelopment of the site which is of insufficient size to satisfactorily accommodate a dwellinghouse; and (iii) it would add to congestion in the common access lane due to the inadequate parking provision and ground available for manoeuvring vehicles, to the detriment of traffic safety in the area.
5. North Coast and Cumbraes Local Plan Area
5.1 N/03/01101/PP: Largs: 32 Kelvin Walk
Mr. Foley, 32 Kelvin Walk, Largs, has applied for planning permission for the installation of replacement doors to the front of the basement flat at that address.
The Sub Committee agreed to refuse the application on the following grounds:-
1. That the proposed development would be contrary to the Development Control Statement contained within the North Ayrshire Finalised Local Plan (excluding Isle of Arran) in that the replacement doors by reason of their material, section sizes and detailing would detract from the appearance and character of the building.
5.2 N/04/00026/LBC: Largs: 32 Kelvin Walk
Mr. Foley, 32 Kelvin Walk, Largs, has applied for listed building consent for the installation of replacement doors to the front of the basement flat at that address.
The Sub Committee agreed to refuse the application on the following grounds:-
1. That the proposed development would be contrary to policies HER8 of the adopted North Coast and Cumbraes Local Plan and policy BE5 of the Finalised North Ayrshire Local Plan (excluding Isle of Arran) in that the proposed replacement doors by reason of their material, section sizes and detailing would detract from the appearance and character of the listed building.
5.3 N/04/00051/PP: West Kilbride: Seamill: 12 Arranview Gardens
Mr. and Mrs. McMail, 12 Arranview Gardens, Seamill, West Kilbride, have applied retrospectively for planning permission for an amendment to previous planning consent no. 01/00767/PP to alter the roof to form a gable at that address. An objection has been received from Angus W. Gillies, 3 Arranview Gardens, Seamill, West Kilbride.
The Sub Committee, having considered the terms of the objection, agreed to grant the application.
6. Enforcement Notice: Kilwinning: 11 - 13 Byres Road
Submitted report by the Assistant Chief Executive (Legal and Protective) on the proposed service of Enforcement Notices with regard to: i) the unauthorised use of the premises as a restaurant/hot food takeaway; and ii) the unauthorised display of an illuminated fascia sign and an illuminated projecting sign at 11-13 Byres Road, Kilwinning.
On 10 November 2003 Mr. J. Healey, the proprietor of Chequers Bar at 11-13 Byres Road, Kilwinning submitted an application for planning permission (ref. 03/00945/PP) for alterations to and the extension of Chequers Bar and to carry out a sub division to form a hot food carry out. Planning permission for these alterations was refused on 20 January 2004 on the following grounds:-
1. That the proposed development would be contrary to policy RET8 of the Adopted Irvine and Kilwinning Local Plan in that due to the lack of parking facilities it would result in parking on the adjacent trunk road in the vicinity of a traffic light controlled junction which would be detrimental to the free flow of traffic and trunk road safety.
2. That the proposed development would be contrary to the Development Control Statement of the Finalised North Ayrshire Local Plan (Excluding Isle of Arran) in that: (i) due to the lack of parking facilities it would result in parking on the adjacent trunk road in the vicinity of a traffic light controlled junction which would be detrimental to the free flow of traffic and trunk road safety; and (ii) by reason of its siting, design and external appearance, the proposed extension would detract from the appearance of the building and the amenity of the surrounding area.
Complaints have been received that part of the premises are now being used as a restaurant/hot food take-away.
Mr. Healey also submitted an application for advertisement consent (ref. 03/01159/ADC) which is invalid. Following complaints in November 2003, a site inspection confirmed that an illuminated fascia sign and an illuminated projecting sign had been erected. Mr. Healey was advised that he was in breach of the Town and Country Planning Control of Advertisement (Scotland) Regulations 1984 and was requested to remove both signs which are considered to be detrimental to the visual amenity of the area. To date neither sign has been removed.
The Sub Committee agreed that Enforcement Notices be served in terms of (i) Section 123 of the Town and Country Planning (Scotland) Act 1997 in relation to the unauthorised use of the premises as a restaurant/hot food take-away; and (ii) Regulation 24 of the Town and Country Planning Control of Advertisements (Scotland) Regulations 1984 in relation to the unauthorised signs.
7. Enforcement Notice: Dreghorn: 153 - 161 Main Street
Submitted report by the Assistant Chief Executive (Legal and Protective) on the proposed service of an Enforcement Notice to secure the removal of the unauthorised windows and installation of approved windows, cills and surrounds at 153-161 Main Street, Dreghorn.
On 11 March 2003 planning permission (ref. 02/00682/PP) was granted subject to conditions to D&A Contractors for a Housing Development at 153-161 Main Street, Dreghorn comprising 11 houses and a block of 12 2 bedroomed flatted dwellinghouses. The conditions required further details to be submitted in respect of the finishing materials, floor levels, drainage arrangements, landscaping scheme, retention of trees and hedges, formation of a footpath link, provision of visibility splays, access and parking, enclosures and plot divisions. The applicants then sold on the site for the flatted dwellinghouses to Messrs. McCartney Homes Limited, Fencedyke Farm, Irvine.
Since the acquisition of the site, it has become evident that McCartney Homes Limited are in breach of a number of planning conditions attached to the original planning consent for the development. These relate to roof materials, window installation and positioning, the height of the flatted dwellinghouses and the materials used for the rear elevations. Details are also required for the means of enclosure or landscaping. On 8 January 2004 the developer was advised of the breaches of consent and was requested to submit an application for an amendment to the original planning consent within 21 days but to date no response has been received.
Failure to comply with some of the conditions attached to the original planning consent can be rectified by the submission of relevant information by the applicant. The failure, however, to instal vertically proportioned windows and cills of an adequate depth and cement bands and to position the windows correctly in the east and north elevations is of particular concern due to the building being located within a conservation area.
The Sub Committee agreed to approve the service of an Enforcement Notice in terms of Section 123 of the Town and Country Planning (Scotland) Act 1997 to require the removal of the unauthorised windows and their replacement with the windows indicated on the approved drawings under planning permission 02/00682/PP at 153-161 Main Street, Dreghorn.
8. Supplementary Guidance on Private Sewerage Systems
Submitted report by the Assistant Chief Executive (Development and Promotion) on the proposed introduction of supplementary guidance on Private Sewerage Systems for the Finalised North Ayrshire Local Plans.
There is currently no specific policy in the finalised Local Plans on the management of private sewerage systems. Such systems have the potential to be bad neighbour developments and may detract from the residential amenity of an area and have adverse implications for health. It is therefore proposed to introduce supplementary guidance on private sewerage systems in support of the statutory development plans. This guidance will assist developers by presenting clear requirements and criteria for future projects which use private sewerage systems.
The Sub Committee agreed to approve the supplementary guidance on private sewerage systems as detailed in the appendix to the report.
9. Isle of Arran Finalised Replacement Local Plan
Submitted report by the Assistant Chief Executive (Development and Promotion) on the Reporter's recommendations following the Public Local Inquiry in September/November 2003 into objections into the Finalised Isle of Arran Local Plan, the Council's response to these recommendations and proposals to proceed to the next stage of consultation on the proposed modifications to the Local Plan.
The Sub Committee agreed on 30 June 2003 to proceed to advertise pre inquiry modifications to the Finalised Isle of Arran Local Plan. No objections to these modifications were received and all remaining unresolved objections to the Local Plan were considered by the Reporter at a Public Local Inquiry in September/November 2003.
The Reporter has now submitted his report on the outcome of the Public Local Inquiry including his recommendations. A report on the Council's proposed response to these recommendations has also been finalised. The proposed modifications generally accord with the Reporter's recommendations and, if agreed, will require to be subject to a further round of public consultation. In terms of the Code of Practice for Local Plan Inquiries, proposed modifications require to be advertised for a 6 week period prior to consideration of adopting the Local Plan.
The Sub Committee agreed (a) to approve the proposed response to the Reporter's recommendations; (b) to authorise consultation on the proposed modifications to the Finalised Isle of Arran Local Plan with a view to the Plan's adoption later this year; and (c) that supplementary guidance on septic tanks approved at item 8 above be inserted into the Finalised Local Plan.
10. Proposed Tree Preservation Order: Hunterston
Submitted report by the Assistant Chief Executive (Development and Promotion) on a proposal to serve a Tree Preservation Order on an area of ground at Hunterston.
The trees planted along the bund which stretches from Hunterston Power Station access road to the Hunterston Ore Terminal access are now mature and provide screening of the industrial area from the main road, as well as a variety of habitats for wildlife and an attractive route for cyclists. In addition, a variety of woodland blocks, treelined paths and groups of trees located around Hunterston House and to the north of the Power Station access road, make an important contribution to the setting of Hunterston House and contribute towards the screening of the Ore Terminal and former construction yard area from the main road. It is proposed that a Provisional Tree Preservation Order be served on the owners of all land within the area as a means of maintaining the visual amenity of the area and ensuring the long term viability of the woodlands. Any objections received would be submitted to a future meeting of the Sub Committee, when considering whether to confirm the order.
The Sub Committee agreed to serve a Provisional Tree Preservation Order in terms of Section 163 of the Town and Country Planning (Scotland) Act 1997, on an area of ground at Hunterston, as shown on the plan accompanying the report, in order to protect existing trees in the interests of the amenity of the area.
11. Naming of New Flatted Housing Development by Ossian Construction Ltd. at Greenock Road, Largs
Submitted report by the Assistant Chief Executive (Development and Promotion) on the naming of a new housing development on a site to the north of Underbank, Greenock Road, Largs.
The Sub Committee agreed to name the development "Rosebank Gardens".
12. N/03/00969/PP: Kilwinning: Site to the South of 2 Townhead
Councillor Munn declared an interest in the following item of business, vacated the Chair and withdrew from the meeting. Councillor Barr assumed the Chair for this item of business.
North Ayrshire Ventures, c/o North Ayrshire Council, Perceton House, Irvine, have applied for planning permission for the erection of an office development with associated access road, footpaths, car parking spaces and landscaping on a site to the south of 2 Townhead, Kilwinning.
The Sub Committee agreed to grant the application subject to the following conditions:-
1. That no car parking additional to that shown on approved drawing number AL (500) P2 shall be formed without the prior written approval of North Ayrshire Council as Planning Authority.
2. That a turning area shall be provided within the site or on other land within the applicant's control to enable delivery/service vehicles to turn and exit in a forward gear, details of which shall be submitted for the written approval of North Ayrshire Council as Planning Authority prior to the commencement of the development.
3. That vehicular access to the site shall be provided in the form of a minor commercial access footway crossing as detailed in sections 5.2 and 10.8 ( and Fig. 10.19) of the Council's Roads Development Guidelines, and shall be designed in such a way that no surface water shall issue from the access onto the carriageway.
4. That visibility splays of 2.5 metres by 90 metres in both directions at the junction with the public road shall be provided and maintained on land within the applicant's control, such that there is no obstruction to visibility above a height of 1.05 metres measured above the adjacent carriageway level to the satisfaction of North Ayrshire Council as Planning Authority.
5. That an additional section of footway shall be provided linking the bus stop on the opposite side of the road with the proposed development, as marked in green on drawing number AL (1250) 1A, to the satisfaction of North Ayrshire Council as Planning Authority.
6. That any significant contamination that becomes evident during the development of the site shall be brought to the attention of North Ayrshire Council as Planning Authority, together with a scheme of remediation prior to any further development taking place.
7. That the surface water arising from the site shall be treated in accordance with the principles and practices contained in CIRIA's "Sustainable Urban Drainage Systems Design Manual for Scotland and Northern Ireland 2000" to the satisfaction of North Ayrshire Council as Planning Authority.
8. That no development shall take place until there has been submitted to and approved by North Ayrshire Council as Planning Authority a scheme of landscaping, which shall include details of species, planting densities, soil treatment and aftercare and shall include indications of all existing trees and hedgerows on the land and details of any to be retained together with measures for their protection in the course of the development.
9. That all planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting season and seeding seasons following the occupation of the buildings or the completion of the development, whichever is the sooner; and any trees or plants which, within a period of five years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of a similar size and species, unless North Ayrshire Council as Planning Authority gives written consent to any variation.
